{"id":756703,"date":"2024-03-01T13:07:46","date_gmt":"2024-03-01T11:07:46","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=756703"},"modified":"2024-03-01T13:07:56","modified_gmt":"2024-03-01T11:07:56","slug":"kieswetter-sends-a-warning-to-banks-in-south-africa","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/banking\/756703\/kieswetter-sends-a-warning-to-banks-in-south-africa\/","title":{"rendered":"Kieswetter sends a warning to banks in South Africa"},"content":{"rendered":"\n<p>The South African Revenue Service (SARS) is prepared to take legal action against South African banks to emphasise their obligations to report questionable transactions made by clients.<\/p>\n\n\n\n<p>This was the warning issued by SARS commissioner Edward Kieswetter, telling <a href=\"https:\/\/www.youtube.com\/watch?v=OJvUFbuyW4s\" target=\"_blank\" rel=\"noreferrer noopener\">NewzroomAfrika<\/a> that banks cannot plead ignorance regarding this responsibility.<\/p>\n\n\n\n<p>\u201cThere are laws in our Financial Intelligence Centre Act that require banks to report certain transactions if they suspect they may be questionable,\u201d Kieswetter said.<\/p>\n\n\n\n<p>He added that banks get close enough to see the repeatability, the nature, and the volume of transactions.<\/p>\n\n\n\n<p>&#8220;So my message to banks would be: you cannot simply follow this from a compliance tick-the-box perspective.\u201d&nbsp;<\/p>\n\n\n\n<p>Instead, the commissioner clarified that banks must manage their duty from a \u201crisk to the entire financial ecosystem\u201d perspective.<\/p>\n\n\n\n<p>He said banks may prefer not to know about suspicious transactions to avoid the need to take action.<\/p>\n\n\n\n<p>However, Kieswetter noted as a general principle, he believes that this idea should be put to the test in a court of law. <\/p>\n\n\n\n<p>&#8220;We are willing to pursue legal action to establish certainty by having the courts make a ruling on this principle,&#8221; he said. <\/p>\n\n\n\n<p>Kieswetter\u2019s comments come after the SARS served Sasfin Bank with a&nbsp;<a href=\"https:\/\/businesstech.co.za\/news\/banking\/755403\/sars-slaps-sasfin-with-r4-9-billion-claim\/\" target=\"_blank\" rel=\"noreferrer noopener\">civil summons<\/a>&nbsp;for&nbsp;R4.87 billion plus interest and costs in the form of a damages claim.<\/p>\n\n\n\n<p>This summons followed an investigation conducted in 2023, which <a href=\"https:\/\/dailyinvestor.com\/finance\/13280\/absa-standard-bank-and-sasfin-implicated-in-gold-mafia-fraud-and-money-laundering\/\" target=\"_blank\" rel=\"noreferrer noopener\">revealed<\/a> that high-ranking officials at Absa, Standard Bank, and Sasfin Bank were involved in laundering millions of dollars in dirty cash in exchange for regular bribes from criminals. <\/p>\n\n\n\n<p>Former foreign exchange clients of Sasfin are said to have worked together as a syndicate and colluded with Sasfin employees to carry out an illegal operation to transfer money out of South Africa. <\/p>\n\n\n\n<p>As a result, SARS was unable to recover income tax, value-added tax and penalties that were allegedly owed by Sasfin&#8217;s former clients and, therefore, launched a summons against the bank for a sum of R4.87 billion. <\/p>\n\n\n\n<p>However, Sasfin argued that it is unjust for banks to be held responsible for taxes their clients have failed to pay.<\/p>\n\n\n\n<p>\u201cThe legal opinion is unequivocal that the claim falls outside of the recognised parameters of applicable law and has a very remote likelihood of success,\u201d the bank said.&nbsp;<\/p>\n\n\n\n<p>This response came after the bank obtained a legal opinion from ENS, which stated that the claim falls outside of the recognised parameters of applicable law and has little chance of success.<\/p>\n\n\n\n<p>\u201cOn the basis of this strong legal opinion, Sasfin Holdings concluded that the claim will not result in the recognition of any liability.\u201d<\/p>\n\n\n\n<p>\u201cThe board of directors of Sasfin Holdings remains of the view that SARS\u2019 claim has no merit and has little chance of success.\u201d<\/p>\n\n\n\n<p>Therefore, the bank added that it would defend the claim, and given that this involves a defended trial action, the matter is only likely to come to trial in several years\u2019 time.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>Read: <a href=\"https:\/\/businesstech.co.za\/news\/banking\/756083\/fnb-sounds-the-alarm-for-consumers-in-south-africa\/\">FNB sounds the alarm for consumers in South Africa<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>SARS commissioner Edward Kieswetter has warned South African banks that the tax service is willing to go to court to hold them accountable.<\/p>\n","protected":false},"author":10,"featured_media":756773,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[961],"tags":[3246,853],"class_list":["post-756703","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-banking","tag-sars","tag-south-africa"],"_links":{"self":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/756703","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/users\/10"}],"replies":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/comments?post=756703"}],"version-history":[{"count":5,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/756703\/revisions"}],"predecessor-version":[{"id":756779,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/756703\/revisions\/756779"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media\/756773"}],"wp:attachment":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media?parent=756703"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/categories?post=756703"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/tags?post=756703"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
