{"id":75674,"date":"2014-12-10T14:04:42","date_gmt":"2014-12-10T12:04:42","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=75674"},"modified":"2014-12-10T14:04:42","modified_gmt":"2014-12-10T12:04:42","slug":"sa-porn-tv-appeal-bid-dismissed","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/media\/75674\/sa-porn-tv-appeal-bid-dismissed\/","title":{"rendered":"SA porn TV appeal bid dismissed"},"content":{"rendered":"<p>An order to remit a decision on the licensing of three pay porn channels back to the Independent Communications Authority of SA (Icasa) was upheld in the Western Cape High Court on Wednesday.<\/p>\n<p>Judge Lee Bozalek said he was correct in ruling that Icasa re-consider its decision to licence On Digital Media&#8217;s (ODM) porn pay channels, rather than apply the discretion himself.<\/p>\n<p>ODM (operating as Top TV and later StarSat) was granted three licences on April 23 last year to broadcast Playboy TV, Desire TV, and Brazzers, subject to conditions.<\/p>\n<p>Last month, Bozalek reviewed Icasa&#8217;s licensing decision and set it aside after consolidated applications by the Justice Alliance of SA (Jasa), Doctors for Life, and Cause for Justice.<\/p>\n<p>The organisations had argued that Icasa erred in making its decision.<\/p>\n<p>ODM applied for leave to appeal the ruling, which was dismissed on Wednesday.<\/p>\n<p>Jasa said in a statement the judgment meant the porn channels could no longer air.<\/p>\n<p>&#8220;The effect of the judgment is that broadcasting of the porn channels must cease forthwith as from today,&#8221; it said in a statement.<\/p>\n<p>&#8220;The respondents&#8217; options now are to petition the Supreme Court of Appeal (SCA) or accept the judge&#8217;s ruling and go back to Icasa.&#8221;<\/p>\n<p>Bozalek said it was not up to the court to &#8220;sever the good from the bad&#8221; in the licensing decision.<\/p>\n<p>&#8220;These are matters which quintessentially lie in the province and expertise of Icasa.
