worst-run municipalities in South Africa"},"content":{"rendered":"\n<p>Forty-one (41) of the country&#8217;s 257 municipalities (~16%) are currently under administration, up from the 32 <a href=\"https:\/\/businesstech.co.za\/news\/trending\/741577\/south-africas-32-most-dysfunctional-municipalities\/\"><strong>reported at the beginning of 2024.<\/strong><\/a><\/p>\n\n\n\n<p>This was outlined by Minister of Cooperative Governance and Traditional Affairs (CoGTA) Velenkosini Hlabisa in response to recent question posed to him in Parliament by ANC&#8217;s Annah Gela.<\/p>\n\n\n\n<p>The responsibilities of municipalities include effectively organising and executing their administration, budgeting, and planning to prioritise the community&#8217;s fundamental needs and support social and economic development.<\/p>\n\n\n\n<p>They are also responsible for providing essential public services, including water, electricity, waste disposal, public health, and transportation.<\/p>\n\n\n\n<p>However, when a municipality does not fulfil these obligations, the provincial and\/or national executive is able to intervene under section 139 of the Constitution to ensure fulfilment of that obligation.<\/p>\n\n\n\n<p>Section 139 (1), (4) and (5) allows the provincial executive to intervene in a municipality if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A municipality cannot or does not fulfil an obligation in terms of the Constitution or legislation to approve a budget or any revenue-raising measures necessary to give effect to the budget.<\/li>\n\n\n\n<li>A municipality, because of a crisis in its financial affairs, is in serious or persistent material breach of its obligations to provide basic services or to meet its financial commitments or admits that it is unable to meet its obligations or financial commitments.<\/li>\n<\/ul>\n\n\n\n<p>Many of these municipalities are repeat offenders.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Municipalities under administration<\/h3>\n\n\n\n<p>According to the information given by the CoGTA minister, the municipalities currently under administration href=\"https:\/\/www.cogta.gov.za\/index.php\/docs\/state-of-local-government-progress-on-the-implementation-of-municipal-support-and-improvement-plans-msip\/\" target=\"_blank\" rel=\"noreferrer noopener\">State of Local Government report<\/a>\u00a0presented to parliament\u2019s portfolio committee at the end of 2023, only 11.67% of the country\u2019s municipalities are defined as being \u2018stable\u2019.<\/p>\n\n\n\n<p>Just over a quarter are defined as being \u2018dysfunctional\u2019, which exacerbates their risks of being placed under administration.<\/p>\n\n\n<div Committee on CoGTA, the South African Local Government Association (Salga) said that the \u201clocal government is inadequately equipped to fulfil its developmental agenda.\u201d<\/p>\n\n\n\n<p>They further expressed concerns about the declining level of service delivery, instability, weakening capacity of municipalities, and the debt owed to municipalities that impinge on their performance.&nbsp;<\/p>\n\n\n\n<p>According to Salga, there are four root causes for the \u201cdigression and decline\u201d of the trajectory of the developmental impact of many local governments, being:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Poor political leadership capacity and weak administrative management;<\/li>\n\n\n\n<li>Inefficient and non-integrated LG delivery mechanisms, systems and processes to enable service delivery;<\/li>\n\n\n\n<li>Ineffective utilisation of financial resources (poor financial administration)&nbsp; &amp; inability to collect revenue, and insufficient fiscus allocation;<\/li>\n\n\n\n<li>Degenerating infrastructure and non-existent or poor services provided to local communities.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-embed class=\"wp-block-heading\">Interventions by Departments<\/h3>\n\n\n\n<p>The government may intervene in distressed municipalities through various measures, including financial assistance, administrative support, or even placing them under administration to restore functionality and service delivery \u2013 which has been the case for the 41 abovementioned municipalities.<\/p>\n\n\n\n<p>At the start of his term as minister, Hlabisa announced that his department is not scared to dissolve dysfunctional municipalities and call for re-elections, citing issues like corruption, political instability, and poor service delivery as reasons for this focus. <\/p>\n\n\n\n<p>He stressed that waiting idly by until 2026 for new leadership is not an option.<\/p>\n\n\n\n<p>He called for &#8220;bold and radical action&#8221; against underperforming municipalities, stating that ineffective leadership serves no purpose and the government will intervene under Section 139 of the Constitution to support these municipalities.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-wp-embed is-provider-businesstech wp-block-embed-businesstech\"><div
