{"id":806179,"date":"2025-01-09T08:31:14","date_gmt":"2025-01-09T06:31:14","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=806179"},"modified":"2025-01-09T09:08:04","modified_gmt":"2025-01-09T07:08:04","slug":"flysafair-in-hot-water","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/business\/806179\/flysafair-in-hot-water\/","title":{"rendered":"FlySafair in hot water"},"content":{"rendered":"\n<p>The National Consumer Commission (NCC) has launched an investigation into FlySafair after the airline admitted to overbooking practices on social media.<\/p>\n\n\n\n<p>This stems from a social media storm over overbooked flights impacting people&#8217;s travel plans.<\/p>\n\n\n\n<p>FlySafair reportedly overbooked a flight over the past weekend, leaving a passenger stranded despite having paid to secure a seat on the flight.<\/p>\n\n\n\n<p>\u201cSo we show up at the airport, and FlySafair says we don\u2019t have seats for the same flight we paid for,\u201d the passenger said in a&nbsp;<a href=\"https:\/\/x.com\/Miles_Nsala\/status\/1875792268680159642\">post<\/a> on X (formerly Twitter).<\/p>\n\n\n\n<p>FlySafair&nbsp;<a href=\"https:\/\/x.com\/FlySafair\/status\/1875810022627889598\">responded<\/a>, apologising for the inconvenience and explaining that it overbooks flights to ensure it can keep our tickets as affordable as possible for passengers.<\/p>\n\n\n\n<p>\u201cWe do see how inconvenient this can be and therefore offer compensation for passengers that were not able to take the flight they\u2019ve booked,\u201d FlySafair said.<\/p>\n\n\n\n<p>In response to this, the NCC published a statement on 8 January 2025, saying that it has noted concerns in the media, including social media platforms, regarding incidents of FlySafair overbooking and\/or overselling practices.<\/p>\n\n\n\n<p>On this basis, it announced that it has initiated an investigation into the conduct of overbooking and\/or overselling by FlySafair to assess and review compliance with provisions of the Consumer Protection Act.<\/p>\n\n\n\n<p>Two notable provisions the NCC said that they are looking at are sections 47 and 48(1)(b).<\/p>\n\n\n\n<p>These prevent suppliers from overselling and overbooking goods and services and protect consumers without remedying the situations, as well as unfair, unreasonable, or unjust terms and conditions in agreements.<\/p>\n\n\n\n<p>The NCC said that it has established communication with the airline and required relevant information to kick-start the investigation.<\/p>\n\n\n\n<p>Acting NCC Commissioner, Hardin Ratshisusu, said that &#8220;the NCC will prioritise this investigation given the nature of the allegations.&#8221;<\/p>\n\n\n\n<p>&#8220;Consumers affected by this practice are urged to come forward and provide information that could assist the investigation,&#8221; he added.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2023\/04\/Flysafair.png\"><img decoding=\"async\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2023\/04\/Flysafair-1024x683.png\" alt=\"\" class=\"wp-image-683679\"\/><\/a><\/figure>\n\n\n\n<p>Speaking to&nbsp;<a href=\"https:\/\/www.youtube.com\/watch?v=JbJ1KzEmG9E\">Newzroom Afrika<\/a>, aviation analyst Guy Leitch explained that overbooking is common in the aviation industry.<\/p>\n\n\n\n<p>Leitch said that overbooking is a common practice across the airline industry, not just with FlySafair.<\/p>\n\n\n\n<p>He explained that airlines often sell more seats than available, anticipating that some passengers will not show up. During peak times, this helps airlines maximize revenue. <\/p>\n\n\n\n<p>If all passengers do show up, airlines may offer cash incentives for volunteers to take a later flight.<\/p>\n\n\n\n<p>Leitch emphasised that he believes that the Consumer Protection Act does not consider this a violation, as there are no specific protections against overbooking.<\/p>\n\n\n\n<p>He added that airlines are unlikely to be at fault if they have made reasonable efforts to ensure timely departures.<\/p>\n\n\n\n<p>However, he noted that some passengers might face hefty financial consequences if such an incident prevents them from catching a connecting flight.
