{"id":814477,"date":"2025-03-03T14:30:00","date_gmt":"2025-03-03T12:30:00","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=814477"},"modified":"2025-03-03T13:21:18","modified_gmt":"2025-03-03T11:21:18","slug":"crucial-r200-billion-sector-in-south-africa-under-fire","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/government\/814477\/crucial-r200-billion-sector-in-south-africa-under-fire\/","title":{"rendered":"Crucial R200 billion sector in South Africa under fire"},"content":{"rendered":"\n<p>Spaza shops had to ensure that they register their establishments with the South African government by 28 February 2025, or face fines, closures or other repercussions.<\/p>\n\n\n\n<p>However, some experts say that while this clampdown intends to formalise the sector, challenges arise from impractical requirements, selective enforcement, and corruption opportunities.<\/p>\n\n\n\n<p>Spaza shops are described as the lifeblood of South African townships. <\/p>\n\n\n\n<p>Research from&nbsp;<a href=\"https:\/\/www.tradeintelligence.co.za\/\" target=\"_blank\" rel=\"noreferrer noopener\">Trade Intelligence<\/a>&nbsp;estimates its size to be around&nbsp;<strong>R197 billion in 2023<\/strong>, with at least 11.1 million people regularly shopping in its roughly 150,000 stores.<\/p>\n\n\n\n<p>However, they have been increasingly under the microscope. In October 2024, six children tragically died after consuming snacks purchased from local spaza shops.<br><br>The South African government launched an aggressive regulatory crackdown on the market, focusing strongly on foreign-owned shops.<\/p>\n\n\n\n<p>In November 2024, President Cyril Ramaphosa mandated that all spaza shops and food-handling facilities register with their municipalities within 21 days or face closure if noncompliant.<\/p>\n\n\n\n<p>The deadline passed on December 17, 2024, but it was extended to <strong>February 28, 2025<\/strong>.<\/p>\n\n\n\n<p>Broadly, the government&#8217;s regulatory objectives are said to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Enforce hygiene standards;<\/li>\n\n\n\n<li>Promote fair competition;<\/li>\n\n\n\n<li>Protect consumers; and <\/li>\n\n\n\n<li>Tackle critical issues such as waste management, environmental health, and illegal practices like fronting and undocumented immigration.<\/li>\n<\/ul>\n\n\n\n<p>While these regulations intend to formalise the sector, Trade Intelligence Senior Analyst <a href=\"https:\/\/www.linkedin.com\/in\/ACoAABhd3-0BdKSUjxQixljgtkf4xCAcNFaxRVU\"><\/a>Tshegofatso Modise and Yebo Fresh&#8217;s <a href=\"https:\/\/www.linkedin.com\/in\/ACoAACBt1G0B6f3Cjj87jAT0b5AO8LhhBg397DQ\"><\/a>Thandeka Khumalo and <a href=\"https:\/\/www.linkedin.com\/in\/ACoAAAfzK0kBEWMQteqfZmWCGYabccwrO96tf3Y\"><\/a>Simon Peters have raised concerns about the approach taken, its effectiveness, and potential unintended consequences. <\/p>\n\n\n\n<p>The experts cited challenges that arise from impractical requirements, selective enforcement, and corruption opportunities.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/02\/Spaza-shop-.png\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/02\/Spaza-shop--1024x576.png\" alt=\"\" class=\"wp-image-814551\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/02\/Spaza-shop--1024x576.png 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/02\/Spaza-shop--300x169.png 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/02\/Spaza-shop--768x432.png 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/02\/Spaza-shop-.png 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Regulations, requirements and the reality<\/h2>\n\n\n\n<p>Government regulations aim to ensure public health and fair competition and formalize the informal economy.<\/p>\n\n\n\n<p>Spaza shop owners must meet hygiene standards, comply with immigration laws, and register with valid documentation. <\/p>\n\n\n\n<p>Requirements include health certificates, trading licenses, and business registration, promoting safer, sustainable operations.<\/p>\n\n\n\n<p>However, Modise, Khumalo and Peters said that the practical implementation of these regulations often &#8220;diverges significantly from their intended outcomes&#8221;.<\/p>\n\n\n\n<p>One primary challenge cited is &#8220;the impracticality of certain requirements,&#8221; which can open doors to extortion. <\/p>\n\n\n\n<p>For example, the demand for title deeds as proof of business location excludes many shop owners, particularly foreign nationals.<\/p>\n\n\n\n<p>This has resulted in local citizens registering businesses on behalf of foreigners, creating opportunities for exploitation and disputes over property ownership.<\/p>\n\n\n\n<p>Initiatives like the National Cleanup Campaign, which aims to improve waste disposal practices, have had limited impact due to a lack of sustained enforcement and public cooperation.<\/p>\n\n\n\n<p>Modise, Kumalo and Peters also said that &#8220;inspectors are often inadequately trained.&#8221; <\/p>\n\n\n\n<p>This leads to a focus on superficial compliance issues, such as expired stock, rather than deeper concerns like proper product categorisation, storage conditions, and overall good business practices.<\/p>\n\n\n\n<p>&#8220;This superficial enforcement allows non-compliant shops to continue operating, undermining the credibility of the regulatory framework,&#8221; said the analysts.<\/p>\n\n\n\n<p>Enforcement efforts are also often sporadic, with many spaza shops closing temporarily during raids and reopening shortly afterward.<\/p>\n\n\n\n<p>The uneven enforcement of new spaza shop regulations has raised concerns that &#8220;foreign traders&#8230;are being targeted under the guise of consumer protection&#8221;. <\/p>\n\n\n\n<p>&#8220;While these traders have outcompeted local shop owners through lower prices, efficient supply chains, and extended hours, removing them does not guarantee that South African entrepreneurs will fill the gap,&#8221; explained the analyst.<\/p>\n\n\n\n<p>She said structural challenges, such as limited access to bulk-buying discounts, financial support, and crime risks, persist.<\/p>\n\n\n\n<p>Additionally, foreign-owned spaza shops contribute an estimated R25 billion annually in rent, benefiting South African landlords.<\/p>\n\n\n\n<p>The spaza shop registration announcement in late 2024 caused uncertainty, leading traders to delay restocking and consumers to adjust their shopping habits. <\/p>\n\n\n\n<p>This disruption impacted sales patterns, as indicated by sell-out data collected by Yebo Fresh. <\/p>\n\n\n\n<p>While experts believe the impact will be short-term, the approaching deadline may have a further influence.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/02\/unnamed-5-e1740729779576.png\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/02\/unnamed-5-1024x683.png\" alt=\"\" class=\"wp-image-814672\"\/><\/a><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Going forward<\/h2>\n\n\n\n<p>Smollan trade expert Richard Mamokeane argues that the real issue extends beyond expired goods, pointing out that many health hazards stem from illicit pesticides sold in informal markets, not the shops.<\/p>\n\n\n\n<p>Mamokeane suggests stricter border enforcement rather than targeting traders, which would be a more practical solution as counterfeit goods often enter the country through weak port controls.<\/p>\n\n\n\n<p>Modise, Khumalo and Peters say that the &#8220;spaza shop debate is about more than just regulation; it is about recognising the vital role that the informal economy plays in South Africa.&#8221;<\/p>\n\n\n\n<p>They said that regulation efforts must strike a balance to protect communities without causing harm. Policies should be fair, practical, and considerate of the informal economy.<\/p>\n\n\n\n<p>They added that poorly designed regulations can foster corruption and bribery, with a key issue being a &#8220;narrow focus on spaza shops while overlooking the broader informal sector.&#8221;<\/p>\n\n\n\n<p>Mamokeane suggests that the government should collaborate with industry experts and private partners instead of targeting individual traders to create a more effective framework.<\/p>\n\n\n\n<p>This should include stronger import controls, better market access for local entrepreneurs, and education on safe business practices. <\/p>\n\n\n\n<p>Without addressing systemic issues, the experts worry that regulations may worsen existing challenges rather than improve food safety and compliance.<\/p>\n\n\n\n<p>&#8220;While this effort aims to regulate the sector, does it&nbsp;<em>\u2018really\u2019<\/em>&nbsp;solve ongoing food safety and compliance challenges?&#8221; said Modise.<\/p>\n\n\n\n<p>&#8220;A broader approach is needed, including better waste management and continued support for these small businesses,&#8221; she added.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Spaza shops had to register by February 28, 2025, or face closure.
