{"id":815762,"date":"2025-03-07T11:00:00","date_gmt":"2025-03-07T09:00:00","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=815762"},"modified":"2025-03-07T11:01:58","modified_gmt":"2025-03-07T09:01:58","slug":"ramaphosas-phala-phala-report-classified-as-top-secret","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/government\/815762\/ramaphosas-phala-phala-report-classified-as-top-secret\/","title":{"rendered":"Ramaphosa&#8217;s Phala Phala report classified as &#8216;Top-Secret&#8217;"},"content":{"rendered":"\n<p>Minister of Police Senzo Mchunu has said that the Independent Police Investigative Directorate (IPID) report on the controversial Phala Phala farm theft has been classified as &#8220;top secret.&#8221;&nbsp;<\/p>\n\n\n\n<p>This was revealed in response to a <a href=\"https:\/\/pmg.org.za\/committee-question\/28227\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>parliamentary Q&amp;A session<\/strong><\/a>, where questions about the report were asked by the African Transformation Movement (ATM) leader, Vuyolwethu Zungula.<\/p>\n\n\n\n<p>The Phala Phala saga began in June 2022 when criminal charges were laid against President Cyril Ramaphosa and members of his security detail.<\/p>\n\n\n\n<p>Former director-general at the State Security Agency Arthur Fraser alleged that Ramaphosa and his team had covered up a February 2020 burglary at his game farm, where large sums of foreign currency\u2014allegedly concealed in furniture\u2014were stolen.<\/p>\n\n\n\n<p>The money, reportedly around $580,000, was said to be a payment from Sudanese businessman Hazim Mustafa for 20 buffalo.<\/p>\n\n\n\n<p>In his parliamentary Q&amp;A, Zungula asked Mchunu when the IPID report would be released, given the repeated calls for transparency regarding the saga and its publication.&nbsp;<\/p>\n\n\n\n<p>Mchunu responded that the investigation had been completed and that IPID had referred its recommendation report to the South African Police Service (SAPS) on 3 October 2023.&nbsp;<\/p>\n\n\n\n<p>Mchunu added that IPID was satisfied with SAPS\u2019s response, but the report was classified as &#8220;top secret&#8221; under Paragraph 3.4.4 of the Minimum Information Security Standards, meaning it cannot be disclosed unless formally declassified.<\/p>\n\n\n\n<p>Zungula further questioned why the report had not been released despite nine formal requests from his office and 11 complaints.&nbsp;<\/p>\n\n\n\n<p>Mchunu replied that it is impermissible to make available a classified report for the purpose that ATM has requested it for.&nbsp;<\/p>\n\n\n\n<p>\u201cIn essence, there is no delay in making the report available, but it is not allowed to make it available,&#8221; said the police minister.&nbsp;<\/p>\n\n\n\n<p>Zungula then asked if Mchunu would ensure the immediate release of the \u2018top-secret\u2019 IPID report, arguing that there seemed to be a deliberate attempt to suppress it.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/07\/Senzo-Mchunu.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/07\/Senzo-Mchunu-1024x576.jpg\" alt=\"\" class=\"wp-image-781581\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/07\/Senzo-Mchunu-1024x576.jpg 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/07\/Senzo-Mchunu-300x169.jpg 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/07\/Senzo-Mchunu-768x432.jpg 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/07\/Senzo-Mchunu.jpg 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><figcaption class=\"wp-element-caption\"><em>Minister of Police Senzo Mchunu<\/em><\/figcaption><\/figure><\/div>\n\n\n<p>However, Mchunu dismissed this and said that while the IPID reports to the minister, the minister may not interfere with its operations.&nbsp;<\/p>\n\n\n\n<p>\u201cTo suggest that the minister should ensure that IPID releases an investigation report is similar to suggesting that the minister must interfere with IPID operations.&nbsp;<\/p>\n\n\n\n<p>\u201cAs indicated above, IPID has classified the report &#8216;top secret,&#8217; and to suggest that the report is suppressed is disingenuous,&#8221; the police minister said.&nbsp;<\/p>\n\n\n\n<p>While this report remains classified, other investigations into the Phala Phala matter have been made public.&nbsp;<\/p>\n\n\n\n<p>In August 2023, the South African Reserve Bank (SARB) <strong><a href=\"https:\/\/businesstech.co.za\/news\/government\/712520\/reserve-bank-clears-ramaphosa-in-phala-phala-saga\/\" target=\"_blank\" rel=\"noreferrer noopener\">concluded<\/a><\/strong> that no exchange control laws had been violated in the alleged transaction between Phala Phala farm and Mustafa.<\/p>\n\n\n\n<p>SARB\u2019s investigation focused on whether the sale of buffalo to Mustafa constituted a breach of exchange control regulations.&nbsp;<\/p>\n\n\n\n<p>The central bank determined that there was no contravention because the transaction had never been &#8220;perfected.&#8221;&nbsp;<\/p>\n\n\n\n<p>In other words, since the buffalo were never delivered, the deal did not meet the necessary conditions to require a declaration under exchange control laws.&nbsp;<\/p>\n\n\n\n<p>&#8220;Thus, the SARB cannot conclude that there was any contravention of the Exchange Control Regulations\u2026 by Ntaba Nyoni Estates CC (the entity involved) or, for that matter, by the President,&#8221;
