{"id":820770,"date":"2025-04-14T10:34:24","date_gmt":"2025-04-14T08:34:24","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=820770"},"modified":"2025-04-14T10:34:31","modified_gmt":"2025-04-14T08:34:31","slug":"important-south-african-town-taken-over-by-gangsters","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/government\/820770\/important-south-african-town-taken-over-by-gangsters\/","title":{"rendered":"Important South African town taken over by gangsters"},"content":{"rendered":"\n<p>Non-profit organisation Sakeliga has approached the courts to seek urgent intervention from President Cyril Ramaphosa and his cabinet to address the rapidly deteriorating Ditsobotla Local Municipality.<\/p>\n\n\n\n<p>Ditsobotla is located in the North West province and consists of Lichtenburg, Coligny, and Ga-Raphalane, home to over 200,000 residents.<\/p>\n\n\n\n<p>It is a significant agricultural area boasting important manufacturing, wholesale, and retail industries.<\/p>\n\n\n\n<p>However, the municipality has been plagued by a collapse in basic services, political instability, corruption and financial mismanagement.<\/p>\n\n\n\n<p>The Ditsobotla Local Municipality recently failed to submit financial reports to the Auditor General for scrutiny.<\/p>\n\n\n\n<p>President Cyril Ramaphosa visited Ditsobotla in November 2022 and said it was \u201ca town taken over by gangsterism\u201d.<\/p>\n\n\n\n<p>&#8220;Ditsobotla is a typical example of a municipality captured by criminal elements. They got into the municipality, captured it, and money was just being siphoned&nbsp;out,&#8221; he said.,<\/p>\n\n\n\n<p>During the visit, the President lamented the failure of electricity, water provision, refuse removal and other basic services.<\/p>\n\n\n\n<p>Having been dissolved before his visit, Ramaphosa said that after 14 December 2022, there would be a &#8220;municipality that is fit for purpose\u201d.<\/p>\n\n\n\n<p>He added that Ditsobotla was going to serve the people&#8221; following the by-elections. Photo: Seth Thorne<\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">The application<\/h2>\n\n\n\n<p>Sakeliga says its new court application follows an October 2023 order for provincial intervention under section 139(5) of the Constitution.<\/p>\n\n\n\n<p>However, due to what it describes as a failure from the province, they now seek the highest form of intervention\u2014national takeover under section 139(7).<\/p>\n\n\n\n<p>They argue the President and cabinet should have acted a long time ago, but grossly neglected their duty.<\/p>\n\n\n\n<p>Sakeliga has filed a court application asking for a declaration that the President, Cabinet, and specific ministers are acting unlawfully and unconstitutionally by failing to intervene in the collapse of the Ditsobotla.<\/p>\n\n\n\n<p>They are requesting that the court order the President and Cabinet to take over the intervention from the provincial government.<\/p>\n\n\n\n<p>This includes implementing the approved municipal recovery plan and reporting to the court within 10 days on restoring water and power.<\/p>\n\n\n\n<p>The application calls for the completion of this work within 30 days, followed by ongoing maintenance and monthly, sworn progress reports to both the court and Sakeliga.<\/p>\n\n\n\n<p>It also calls for the government to engage with Sakeliga quarterly and continue intervention until the crisis is resolved. Once granted, the court order must be delivered to Parliament.<\/p>\n\n\n\n<p>Sakeliga says that \u201cthe requested order will provide the president and his subordinates with an opportunity to correct their failure and fulfil their responsibilities.\u201d<\/p>\n\n\n\n<p>However, \u201cjudging by growing state failure countrywide, this cannot be counted on,&#8221; Sakeliga added.<\/p>\n\n\n\n<p>They further ask the court to allow future legal action without requiring a new case should the national executive fail again, echoing a similar request made in their October 2023 litigation.<\/p>\n\n\n\n<p>Sakeliga warned that such failure would signal a serious constitutional crisis, as section 139 only allows for national intervention, with no fallback if that fails.<\/p>\n\n\n\n<p>\u201cShould the national executive fail yet again, Sakeliga will not hesitate to ask for new relief under article 172 of the Constitution,\u201d they say.<\/p>\n\n\n\n<p>Potential remedies include the appointment of a special master or legal protection for community-led emergency interventions to maintain services.<\/p>\n\n\n\n<p>Sakeliga argues that systemic municipal collapse endangers national stability, citing R100 billion in Eskom debt and the financial failure of many municipalities.<\/p>\n\n\n\n<p>As smaller towns across South Africa fail, residents migrate to already strained cities, risking a nationwide collapse.<\/p>\n\n\n\n<p>They said their legal action in Ditsobotla forms part of a broader strategy to escalate municipal failure to the national level and open the door to non-governmental solutions when the state fails to act.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/01\/Untitled-design-6.png\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/01\/Untitled-design-6-1024x576.png\" alt=\"\" class=\"wp-image-808414\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/01\/Untitled-design-6-1024x576.png 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/01\/Untitled-design-6-300x169.png 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/01\/Untitled-design-6-768x432.png 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/01\/Untitled-design-6.png 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><figcaption class=\"wp-element-caption\">A road in Coligny, Ditsobotla. Photo: Seth Thorne<\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">National intervention<\/h2>\n\n\n\n<p>In February, the DA asked National Treasury to place Ditsobotla Local Municipality under national intervention.<\/p>\n\n\n\n<p>Treasury responded that \u201cat this stage, there are no grounds for a national intervention,\u201d noting the municipality is already under provincial mandatory intervention.<\/p>\n\n\n\n<p>Treasury explained that it developed a Financial Recovery Plan (FRP) for Ditsobotla, which the MEC for Finance approved in August 2023.<\/p>\n\n\n\n<p>A Provincial Executive Representative (PER) was appointed to oversee the implementation of the financial recovery plan.<\/p>\n\n\n\n<p>It emphasised that the municipality must fully cooperate with the PER to ensure the FRP is appropriately executed.<\/p>\n\n\n\n<p>Treasury said that \u201cthe crisis at the Ditsobotla local municipality is deep-rooted and has existed for some time. Therefore, resolving the nature and depth of these problems will require significant time and effort.\u201d<\/p>\n\n\n\n<p>The department said it was premature to invoke section 139(7), as the province has taken active steps. Photo: Seth Thorne<\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">BusinessTech&#8217;s recent visit<\/h2>\n\n\n\n<p><a href=\"https:\/\/businesstech.co.za\/news\/government\/808898\/important-south-african-municipality-has-collapsed\/\"><strong>BusinessTech recently visited Ditsobotla<\/strong><\/a>&nbsp;to witness the situation firsthand by speaking with residents, businesses and other stakeholders.<\/p>\n\n\n\n<p>Residents and businesses have endured prolonged water, electricity, sanitation, and road maintenance failures, leading to regular protests.<\/p>\n\n\n\n<p>As such, capital is being forced to close shop. For example, in 2021, Clover closed its major cheese factory in Ditsobotla, explicitly citing \u201congoing poor service delivery.&#8221;<\/p>\n\n\n\n<p>The ANC in the North West has been discussing merging Ditsobotla with the areas surrounding it after the 2026 local government elections.<\/p>\n\n\n\n<p>\u201cWe have implemented all the interventions that you can think of,\u201d said ANC North West spokesperson Tumelo Maruping, whose party has an outright majority in the province.<\/p>\n\n\n\n<p>\u201cIf the interventions do not work out, post-2026, we are now looking at getting rid of that municipality altogether and merging it with other municipalities,\u201d said Maruping.<\/p>\n\n\n\n<p>Additionally, it recently descended into further chaos amid violent clashes, political infighting, and contested leadership. <\/p>\n\n\n\n<p>A court-ordered reinstatement of dismissed municipal manager Olaotse Bojosinyane led to a violent standoff at the council, leaving two employees shot. <\/p>\n\n\n\n<p>At the same time, opposing political factions\u2014including rival ANC groups and coalition partners\u2014each claimed their own candidate as the legitimate mayor of Ditsobotla. <\/p>\n\n\n\n<p>This deepened the leadership crisis, with competing council meetings and disputed appointments fueling confusion and instability within the already dysfunctional municipality.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Videos from Ditsobotla<\/h2>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"A Town in Crisis: A Resident Talks About Ditsobotla\u2019s Downfall\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/eVvl2jq5Zno?feature=oembed\" frameborder=\"0\" allow=\"accelerometer;
