{"id":822594,"date":"2025-04-29T14:29:17","date_gmt":"2025-04-29T12:29:17","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=822594"},"modified":"2025-04-29T14:29:24","modified_gmt":"2025-04-29T12:29:24","slug":"legal-storm-brewing-over-south-africas-new-employment-laws","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/government\/822594\/legal-storm-brewing-over-south-africas-new-employment-laws\/","title":{"rendered":"Legal storm brewing over South Africa&#8217;s new employment laws"},"content":{"rendered":"\n<p>The Democratic Alliance (DA) is taking the Minister of Employment and Labour to court over the recently gazetted Employment Equity (EE) targets for businesses in South Africa.<\/p>\n\n\n\n<p>The targets are part of the newly published Employment Equity Regulations, 2025, which were gazetted on 15 April and repealed previous laws in force.<\/p>\n\n\n\n<p>The regulations set out specific racial and gender-based numerical targets for businesses across 18 industries in South Africa to achieve over the next five years.<\/p>\n\n\n\n<p>The new EE regulations require businesses in South Africa to employ a workforce that reflects the country\u2019s \u201ceconomically active population\u201d (EAP), nationally or provincially.<\/p>\n\n\n\n<p>Despite decades of implementing such laws in South Africa, the pace of transformation has not met the government&#8217;s expectations.<\/p>\n\n\n\n<p>Many top positions still do not reflect the black majority in the country, and the state now wants to force businesses to comply.<\/p>\n\n\n\n<p>According to the department, the targets have been implemented to ensure the \u201cequitable representation of suitably qualified people from designated groups at all occupational levels in the workforce\u201d.<\/p>\n\n\n\n<p>Designated groups refer to black people (African, coloured and Indian), women and people with disabilities.<\/p>\n\n\n\n<p>Notably, the targets only apply to \u2018designated employers\u2019, which employ more than 50 people. These employers must set these targets in their Employment Equity plans and reports.<\/p>\n\n\n\n<p>Failure to comply with the regulations could cause companies to be referred to the Labour Court and face fines.<\/p>\n\n\n\n<p>However, the department noted that designated employers will not incur penalties or any form of disadvantage if they show reasonable grounds for not complying with the targets.<\/p>\n\n\n\n<p>Designated employers must prepare and implement an EE Plan from 1 September 2025 to 31 August 2030.<\/p>\n\n\n\n<p>In April, the department further added that labour inspectors are \u201cat the ready\u201d to enforce the new laws.<\/p>\n\n\n\n<p>\u201cMore than 50 labour inspectors specialising in employment equity (EE) were put through their paces to prepare them for implementing the EE Amendment Act,\u201d said a department spokesperson.&nbsp;<\/p>\n\n\n\n<p>Department of Employment and Labour\u2019s Employment Equity Directorate Deputy Director Masilo Lefika said a workshop was organised to prepare the EE inspectors as part of capacity building.<\/p>\n\n\n\n<p>These inspectors will conduct inspections, enforce, and improve compliance with the new legislation, the accompanying regulations, and sector EE targets.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Legal challenge<\/h2>\n\n\n\n<figure class=\"wp-block-image size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/09\/high-court.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/09\/high-court-1024x576.jpg\" alt=\"\" class=\"wp-image-789933\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/09\/high-court-1024x576.jpg 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/09\/high-court-300x169.jpg 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/09\/high-court-768x432.jpg 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/09\/high-court.jpg 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/figure>\n\n\n\n<p>However, the DA has launched a constitutional challenge against the new laws, specifically against Section 15a of the Employment Equity Amendment Act.<\/p>\n\n\n\n<p>The party argues that the recent amendments are constitutionally invalid and abuse state power.&nbsp;<\/p>\n\n\n\n<p>\u201cSection 15a violates Section 9 of the Constitution, which guarantees equality before the law and prohibits unfair discrimination,\u201d said the DA.&nbsp;<\/p>\n\n\n\n<p>\u201cA law that forces employers to fire or refuse to hire people based on race, whether they are black, coloured, Indian, or white, is not redress. It is unconstitutional discrimination.\u201d<\/p>\n\n\n\n<p>One of the most significant additions was empowering the Minister of Employment and Labour to set specific sectoral employment targets for designated employers to follow.<\/p>\n\n\n\n<p>\u201cThe Minister\u2019s powers under Section 15a are vague, unchecked, and dangerously broad,\u201d added the opposition party.<\/p>\n\n\n\n<p>\u201cThe so-called &#8216;targets&#8217; are not guidelines\u2014they are binding quotas, enforceable under the threat of penalties of up to 10% of a company\u2019s turnover.\u201d<\/p>\n\n\n\n<p>The DA further stressed that the law empowers the Minister to impose these quotas without clear criteria.<\/p>\n\n\n\n<p>\u201cThis violates the Dawood principle, which says that intelligible and clear legal standards must guide public officials.\u201d&nbsp;<\/p>\n\n\n\n<p>The party pointed out that this case is not about resisting redress.
