{"id":829314,"date":"2025-06-25T11:02:08","date_gmt":"2025-06-25T09:02:08","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=829314"},"modified":"2025-06-25T11:02:13","modified_gmt":"2025-06-25T09:02:13","slug":"eskoms-plan-to-use-the-expropriation-act-for-land-comes-with-a-price","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/energy\/829314\/eskoms-plan-to-use-the-expropriation-act-for-land-comes-with-a-price\/","title":{"rendered":"Eskom&#8217;s plan to use the Expropriation Act for land comes with a price"},"content":{"rendered":"\n<p>Eskom is looking to use the Expropriation Act to fast-track its transmission line project in South Africa, but it is unlikely to get a free ride paying &#8216;nil compensation&#8217;.<\/p>\n\n\n\n<p>South Africa is set to massively expand its energy sources as it tries to add more renewable energy to the strained grid.<\/p>\n\n\n\n<p>This will require thousands of kilometres of new transmission lines to be laid across the country to make room for more generation.<\/p>\n\n\n\n<p>Eskom&#8217;s 2022 Transmission Development Plan indicated that the country\u2019s transmission infrastructure would need to be expanded by around 14,000 km of extra-high-voltage lines and 170 transformers over the next 10 years.<\/p>\n\n\n\n<p>This would significantly expand the country\u2019s grid, allowing it to accommodate more renewable energy from private producers, at a cost of almost R400 billion.<\/p>\n\n\n\n<p>Unfortunately for Eskom, the project requires large tranches of land to accomplish this, and much of it is privately owned, presenting a significant impediment to the project.<\/p>\n\n\n\n<p>The National Transmission Company of South Africa (NTCSA), a newly formed entity unbundled from Eskom, <a href=\"https:\/\/dailyinvestor.com\/energy\/91138\/expropriation-act-key-to-eskoms-big-grid-expansion-plans\/\"><strong>said<\/strong><\/a> it is now considering using the Expropriation Act to acquire the needed land.<\/p>\n\n\n\n<p>The NTCSA said it has exhausted negotiations with landowners for transmission line servitudes, some of which have lasted up to four years without success.<\/p>\n\n\n\n<p>While a state-owned entity like Eskom or the NTCSA cannot expropriate land, it can apply to the Department of Public Works to expropriate land on its behalf.<\/p>\n\n\n\n<p>The Expropriation Act allows the state to acquire property for a public purpose or in the public interest, subject to just and equitable compensation being paid.<\/p>\n\n\n\n<p>However, the new law has faced severe criticism for allowing the state to acquire properties with &#8216;nil compensation&#8217;, in very strict circumstances. <\/p>\n\n\n\n<p>This raises a question for many landowners on whether they will be compensated if their property is used for power lines under the Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Nil compensation unlikel<\/strong>y<\/h2>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/03\/lethabo-eskom-e1750837126938.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"577\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/03\/lethabo-eskom-e1750837126938-1024x577.jpg\" alt=\"\" class=\"wp-image-756661\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/03\/lethabo-eskom-e1750837126938-1024x577.jpg 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/03\/lethabo-eskom-e1750837126938-300x169.jpg 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/03\/lethabo-eskom-e1750837126938-768x433.jpg 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/03\/lethabo-eskom-e1750837126938.jpg 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/figure><\/div>\n\n\n<p>Although the most debated part of the Expropriation Act is the provision for &#8220;nil compensation,&#8221; there are still many requirements that the state must meet to achieve that outcome.<\/p>\n\n\n\n<p>This includes the Act stating that it must be &#8220;just and equitable&#8221; for no compensation to be paid. This is only applicable for land that is expropriated in the public interest.<\/p>\n\n\n\n<p>Cliffe Dekker Hofmeyr&#8217;s Jackwell Feris and Charles Green said that there is a critical legal distinction between \u201cpublic purpose\u201d and \u201cpublic interest\u201d within the Expropriation Act:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Public purpose relates to expropriation for a specific public use. This includes the development of tangible public infrastructure like roads, schools, dams and energy transmission lines.<\/li>\n\n\n\n<li>Public interest is defined more broadly to include the nation\u2019s commitment to land reform and providing equitable access to natural resources to address the results of past racial discrimination.<\/li>\n<\/ul>\n\n\n\n<p>The development of infrastructure like energy transmission lines is seen as a public purpose, meaning that the provisions for &#8220;nil compensation&#8221; do not apply.<\/p>\n\n\n\n<p>Affected parties will thus be entitled to just and equitable compensation per the Expropriation Act.<\/p>\n\n\n\n<p>The experts added that nil compensation is not automatic, and an expropriating authority or the court must consider all relevant circumstances and ensure a fair outcome.<\/p>\n\n\n\n<p>The Expropriation Act lists specific, non-exhaustive examples where nil compensation might apply, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Unused land held purely for speculative purposes.<\/li>\n\n\n\n<li>State-owned land that an organ of state is not using for its core functions.<\/li>\n\n\n\n<li>Land that the owner has abandoned.<\/li>\n\n\n\n<li>Where the property\u2019s market value is less than or equal to the state\u2019s direct investment in it.<\/li>\n<\/ul>\n\n\n\n<p>&#8220;Any attempt to expropriate land for infrastructure under the &#8216;public interest&#8217; banner to avoid payment would be legally flawed and subject to legal challenge and judicial review,&#8221; they said.<\/p>\n\n\n\n<p>Although it is yet to come into effect, the Expropriation Act will provide a clear legal framework for all of this to take place.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Eskom wants to use the Expropriation Act to expand its transmission network, but &#8216;nil compensation&#8217; won&#8217;t apply.<\/p>\n","protected":false},"author":95,"featured_media":829359,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[9874],"tags":[1523,1164],"class_list":["post-829314","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-energy","tag-cliffe-dekker-hofmeyr","tag-eskom"],"_links":{"self":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/829314","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/users\/95"}],"replies":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/comments?post=829314"}],"version-history":[{"count":3,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/829314\/revisions"}],"predecessor-version":[{"id":829360,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/829314\/revisions\/829360"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media\/829359"}],"wp:attachment":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media?parent=829314"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/categories?post=829314"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/tags?post=829314"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
