{"id":831599,"date":"2025-07-23T07:00:00","date_gmt":"2025-07-23T05:00:00","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=831599"},"modified":"2025-07-22T18:47:30","modified_gmt":"2025-07-22T16:47:30","slug":"all-president-cyril-ramaphosas-commissions-of-inquiries","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/government\/831599\/all-president-cyril-ramaphosas-commissions-of-inquiries\/","title":{"rendered":"All President Cyril Ramaphosa&#8217;s commissions of inquiries"},"content":{"rendered":"\n<p>President Cyril Ramaphosa\u2019s decision to establish a judicial commission of inquiry to look into corruption and criminality within the top brass of the country\u2019s law enforcement agencies has drawn mixed reactions.<\/p>\n\n\n\n<p>While some have hailed it as a key step to deeply investigating these allegations, others have raised concerns over the cost and anticipated limited outcomes.<\/p>\n\n\n\n<p>On 13 July, Ramaphosa responded to explosive claims by KwaZulu-Natal Police Commissioner General Nhlanhla Mkhwanazi about a criminal syndicate allegedly infiltrating South Africa\u2019s law enforcement and intelligence agencies.<\/p>\n\n\n\n<p>\u201cIt is necessary that we establish the facts through an independent, credible and thorough process so that we can safeguard public confidence in the police service\u2026 as we seek to put the era of state capture behind us,\u201d Ramaphosa said.<\/p>\n\n\n\n<p>Commissions of Inquiry are formal investigations into serious public concerns. <\/p>\n\n\n\n<p>Though they can restore trust and offer key recommendations, they are not courts, and their findings are not legally binding, often leading to frustration when no prosecutions follow.<\/p>\n\n\n\n<p>While the ANC welcomed the move as \u201ca clear demonstration of the seriousness with which the President and government respond to allegations of corruption and criminal conduct,\u201d critics across the political spectrum were less enthusiastic.<\/p>\n\n\n\n<p>Since 2018, Ramaphosa has launched five commissions and overseen one other inquiry. <\/p>\n\n\n\n<p>This does not include the numerous non-judicial inquiries, panels and advisory bodies, which are not strictly judicial commissions of inquiry under the Commissions Act or the Constitution.<\/p>\n\n\n\n<p>DA leader and Agriculture Minister John Steenhuisen accused the president of shirking responsibility: \u201cThe President has once again outsourced executive responsibility to a commission.\u201d <\/p>\n\n\n\n<p>He added, \u201cSouth Africans have grown cynical of talk shops, task teams and commissions which they see as buying time and avoiding accountability.\u201d<\/p>\n\n\n\n<p>EFF spokesperson Sinawo Thambo echoed that sentiment, writing: \u201cThe challenge is not a Commission of Inquiry\u2026 as a mechanism, but the track record of implementing recommendations.\u201d<\/p>\n\n\n\n<p>\u201cIt is dismal and has meant matters are set aside till society loses track. The President has not acted. He has kicked the ball to touch and maintained a sense of action.\u201d<\/p>\n\n\n\n<p>GOOD Party\u2019s Brett Herron said existing bodies like the Special Investigating Unit should be used instead, arguing that commissions have proven \u201ctoo slow, too cumbersome, and too costly.\u201d<\/p>\n\n\n\n<p>This raises the questions of which other Commissions of Inquiry President Ramaphosa have launched and what their outcomes were.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Tax Administration and Governance by the South African Revenue Service (SARS) \u2013 Nugent Commission (2018)<\/h2>\n\n\n\n<p>Ramaphosa established the Nugent Commission in May 2018 to investigate governance and operational failures at the SARS, particularly under former Commissioner Tom Moyane.<\/p>\n\n\n\n<p>His leadership was blamed for undermining the agency\u2019s ability to collect revenue.<\/p>\n\n\n\n<p>The commission, chaired by retired Judge Robert Nugent, found significant mismanagement and deliberate weakening of SARS under Moyane\u2019s tenure.<\/p>\n\n\n\n<p>Following an interim report, Ramaphosa fired Moyane in 2018, and Edward Kieswetter was appointed as the new SARS Commissioner, who is credited with reforming the agency.<\/p>\n\n\n\n<p>This commission is considered one of the more impactful ones, as it led to tangible leadership changes and institutional reforms.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/03\/SARS.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/03\/SARS-1024x576.jpg\" alt=\"\" class=\"wp-image-757379\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/03\/SARS-1024x576.jpg 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/03\/SARS-300x169.jpg 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/03\/SARS-768x432.jpg 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/03\/SARS.jpg 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/figure>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Allegations of Impropriety Regarding the Public Investment Corporation (PIC) \u2013 Mpati Commission (2018)<\/h2>\n\n\n\n<p>Launched in October 2018, the Mpati Commission of Inquiry was established to investigate allegations of mismanagement and improper investment decisions at the Public Investment Corporation (PIC), which manages government pension funds.<\/p>\n\n\n\n<p>The commission was mandated to determine whether PIC directors or employees abused their positions for personal gain, whether whistleblower protections were upheld, and whether unfair practices influenced staff remuneration or bonuses.<\/p>\n\n\n\n<p>It was also tasked with reviewing governance structures and other areas of concern within the PIC.<\/p>\n\n\n\n<p>The inquiry followed growing allegations of corruption and maladministration, particularly involving then-CEO Dr. Dan Matjila.<\/p>\n\n\n\n<p>Chaired by Justice Lex Mpati, with assistance from Gill Marcus and Emmanuel Lediga, the commission held 63 days of hearings and heard testimony from 77 witnesses.<\/p>\n\n\n\n<p>It found, among other things, that Matjila had used his position to improperly influence investment decisions for personal or political purposes. Mokgoro Commission (2018-2019)<\/h2>\n\n\n\n<p>The Mokgoro Inquiry, launched in November 2018, investigated misconduct by senior National Prosecuting Authority (NPA) officials Nomgcobo Jiba and Lawrence Mrwebi, amid concerns over political interference during the Zuma era. <\/p>\n\n\n\n<p>Chaired by retired Justice Yvonne Mokgoro, the commission examined their roles in controversial decisions, including the withdrawal of charges against former Crime Intelligence head Richard Mdluli and the protection of politically connected figures. <\/p>\n\n\n\n<p>The report, concluded in April 2019, recommended their removal from office and highlighted systemic issues within the NPA that enabled such misconduct.<\/p>\n\n\n\n<p>Ramaphosa dismissed them shortly after, marking a key step in restoring the NPA\u2019s credibility. <\/p>\n\n\n\n<p>While praised for swift action, unlike the slower Zondo Commission, critics noted the lack of criminal prosecution. <\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/08\/NPA-.png\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/08\/NPA--1024x576.png\" alt=\"\" class=\"wp-image-785888\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/08\/NPA--1024x576.png 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/08\/NPA--300x169.png 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/08\/NPA--768x432.png 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/08\/NPA-.png 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/figure>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Allegations of State Capture, Corruption, and Fraud in the Public Sector &#8211; (Zondo Commission) (2018\u20132022)<\/h2>\n\n\n\n<p>Probably the most high-profile Commission, it was first announced by former President Jacob Zuma, but was implemented and overseen by Ramaphosa after he took office.<\/p>\n\n\n\n<p>The commission was established to investigate allegations that powerful individuals or networks were secretly influencing government decisions for personal gain, alongside widespread corruption and fraud within public institutions.<\/p>\n\n\n\n<p>It followed a recommendation by former Public Protector Thuli Madonsela to investigate widespread allegations of state capture under Zuma, particularly involving the Gupta family and their influence over state institutions.<\/p>\n\n\n\n<p>The commission, chaired by then-Deputy Chief Justice Raymond Zondo and costing nearly R1 billion, ran for four years and uncovered extensive evidence of state capture involving public and private sector actors, implicating over 1,400 individuals.<\/p>\n\n\n\n<p>The Zondo Commission produced six reports exposing corruption in state entities like PRASA, the SSA, and SABC and recommended prosecutions, further probes, and systemic reforms. <\/p>\n\n\n\n<p>While Ramaphosa accepted most of the findings in October 2022 and implemented some actions, such as leadership changes at SARS, the freezing of R14 billion in assets, and the recovery of R5.4 billion, actual prosecutions have been limited.<\/p>\n\n\n\n<p>51 individuals and 27 entities are facing criminal charges, well below the 1,438 individuals and entities in its final report, prompting public frustration of its true effectiveness.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/07\/Ramaphosa-Zondo-1.png\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/07\/Ramaphosa-Zondo-1-1024x576.png\" alt=\"\" class=\"wp-image-831617\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/07\/Ramaphosa-Zondo-1-1024x576.png 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/07\/Ramaphosa-Zondo-1-300x169.png 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/07\/Ramaphosa-Zondo-1-768x432.png 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/07\/Ramaphosa-Zondo-1.png 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><figcaption class=\"wp-element-caption\">President Cyril Ramaphosa and Judge Raymond Zondo following the completion of the commission. Photo: GCIS<\/figcaption><\/figure>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Delays in Investigation and Prosecution of Truth and Reconciliation Commission (TRC) Cases (2025)<\/h2>\n\n\n\n<p>Announced in April 2025 and formalised in May 2025, this commission investigates allegations of interference that delayed the investigation and prosecution of apartheid-era crimes referred by the TRC to the National Prosecuting Authority (NPA).<\/p>\n\n\n\n<p>Chaired by retired Constitutional Court Judge Sisi Khampepe, and assisted by retired Judge President Frans Diale Kgomo and Advocate Andrea Gabriel, it follows a court application by families of apartheid-era victims, seeking justice for unresolved cases. <\/p>\n\n\n\n<p>According to Ramaphosa, it aims to establish the truth about alleged interference and provide closure to affected families.<\/p>\n\n\n\n<p>As of July 2025, the commission is ongoing, with no reported findings yet.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Allegations Regarding Law Enforcement Agencies (2025)<\/h2>\n\n\n\n<p>Announced on July 12, 2025, to investigate explosive allegations by KwaZulu-Natal Police Commissioner Lt. Gen.
