{"id":832058,"date":"2025-07-21T07:00:00","date_gmt":"2025-07-21T05:00:00","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=832058"},"modified":"2025-07-21T07:03:58","modified_gmt":"2025-07-21T05:03:58","slug":"2-more-laws-for-south-africa-waiting-for-ramaphosas-signature","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/government\/832058\/2-more-laws-for-south-africa-waiting-for-ramaphosas-signature\/","title":{"rendered":"2 more laws for South Africa waiting for Ramaphosa\u2019s signature"},"content":{"rendered":"\n<p>President Cyril Ramaphosa has two Bills waiting for his signature, which focus on changes for older persons&#8217; care in South Africa and the 2025 Budget.<\/p>\n\n\n\n<p>Ramaphosa has the Older Persons&#8217; Amendment Bill and the Division of Revenue Bill on his desk.<\/p>\n\n\n\n<p>The President&#8217;s sign-off is the last step in an extensive legislative processes that includes inputs from the National Assembly and the National Council of Provinces, public comment processes, and possible amendments to the Bills.<\/p>\n\n\n\n<p>However, Ramaphosa does have to power to return the Bills to parliament if he believes there are any shortcomings.<\/p>\n\n\n\n<p>For instance, in late 2024, Ramaphosa referred the Regulation of Interception of Communications and Provision of Communication-Related Information Amendment (RICA) Bill back to the National Assembly.<\/p>\n\n\n\n<p>This was due to concerns over the RICA Bill&#8217;s constitutionality, which could allow the courts to set it aside. South Africa&#8217;s previous surveillance laws were considered unconstitutional as they failed to protect privacy.<\/p>\n\n\n\n<p>The President&#8217;s workload regarding legislation has decreased substantially compared to a year ago.<\/p>\n\n\n\n<p>Ahead of the 2024 National Election, parliament pushed several pieces of legislation through, with the President having well over 20 Bills on his desk at times.<\/p>\n\n\n\n<p>Despite the smaller workload, the following Bills still significantly impact South Africa&#8217;s social and economic future.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Older Persons Amendment Bill<\/h2>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/05\/Ramaphosa-signing-2-e1752823954109.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"577\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/05\/Ramaphosa-signing-2-e1752823954109-1024x577.jpg\" alt=\"\" class=\"wp-image-772240\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/05\/Ramaphosa-signing-2-e1752823954109-1024x577.jpg 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/05\/Ramaphosa-signing-2-e1752823954109-300x169.jpg 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/05\/Ramaphosa-signing-2-e1752823954109-768x433.jpg 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2024\/05\/Ramaphosa-signing-2-e1752823954109.jpg 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/figure><\/div>\n\n\n<p>The Bill, which was introduced by the Department of Social Development in 2022, aims to strengthen protection measures for older persons in the country.<\/p>\n\n\n\n<p>Notably, it allows for removing older persons to temporary safe care without a court order, under specific conditions.<\/p>\n\n\n\n<p>It also introduces new definitions to improve interpretation and provides monitoring and evaluation services for older persons.<\/p>\n\n\n\n<p>The Bill was initially introduced and processed by the sixth parliament. However, it lapsed at the end of that parliamentary term.<\/p>\n\n\n\n<p>The National Council of Provinces revived it on 10 December 2024 with certain amendments.<\/p>\n\n\n\n<p>The NCOP passed and referred it to the National Assembly for concurrence in December 2024. The National Assembly passed the Bill in early June 2024 and sent it to the President for assent.&nbsp;<\/p>\n\n\n\n<div data-wp-interactive=\"core\/file\" class=\"wp-block-file\"><object data-wp-bind--hidden=\"!state.hasPdfPreview\" hidden class=\"wp-block-file__embed\" data=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/07\/Older-Persons-Amendment-Bill.pdf\" type=\"application\/pdf\" style=\"width:100%;height:600px\" aria-label=\"Embed of Older Persons Amendment Bill.\"><\/object><a id=\"wp-block-file--media-76a362b2-e9b0-442c-b94b-3d3de4e8f560\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/07\/Older-Persons-Amendment-Bill.pdf\">Older Persons Amendment Bill<\/a><a href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/07\/Older-Persons-Amendment-Bill.pdf\" class=\"wp-block-file__button wp-element-button\" download aria-describedby=\"wp-block-file--media-76a362b2-e9b0-442c-b94b-3d3de4e8f560\">Download<\/a><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Division of Revenue Bill<\/h2>\n\n\n\n<p>Another Bill waiting for Ramaphosa&#8217;s signature is the Division of Revenue Bill, one of several pieces of legislation introduced during the 2025 National Budget.<\/p>\n\n\n\n<p>The Bill provides for the division of revenue raised nationally among the national, provincial and local spheres of government.<\/p>\n\n\n\n<p>It also determines each province&#8217;s equitable share, allocations to provincial and local governments and the responsibilities of all three spheres of government.<\/p>\n\n\n\n<p>The Money Bills and Related Matters Act requires the Division of Revenue Bill to be introduced simultaneously with the Appropriation Bill.<\/p>\n\n\n\n<p>However, the Appropriation Bill must still be finalised in parliament, and it should take place soon.<\/p>\n\n\n\n<p>The Division of Revenue Bill was only assented to by the President yesterday, 17 July, after being introduced to parliament on 21 May.<\/p>\n\n\n\n<p>The Bills form part of the government&#8217;s third attempt to pass the 2025 Budget after the first and second Budgets contained controversial VAT increases.<\/p>\n\n\n\n<p>The first tabling was delayed in February after the DA, the second largest party in the GNU, aired its displeasure at the last minute over the VAT increase from 15% to 17%.<\/p>\n\n\n\n<p>The second attempt saw Finance Minister Enoch Godongwana make it to the tabling stage, where he introduced a one percentage point increase in VAT over two years.<\/p>\n\n\n\n<p>This was challenged again by the DA, which took the matter to court.<\/p>\n\n\n\n<p>The Western Cape High Court set aside the National Assembly and the National Council of Provinces&#8217;
