{"id":840290,"date":"2025-10-17T16:30:00","date_gmt":"2025-10-17T14:30:00","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=840290"},"modified":"2025-10-17T16:22:01","modified_gmt":"2025-10-17T14:22:01","slug":"another-international-finance-company-hit-with-sanctions-in-south-africa","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/business\/840290\/another-international-finance-company-hit-with-sanctions-in-south-africa\/","title":{"rendered":"Another international finance company hit with sanctions in South Africa"},"content":{"rendered":"\n<p>The South African Reserve Bank (SARB) has hit Access Forex with administrative sanctions for failure to abide by the Financial Intelligence Centre Act (FIC Act).&nbsp;<\/p>\n\n\n\n<p>The SARB has imposed administrative sanctions on Zimbabwe-based Access Forex, an Authorised Dealer in foreign exchange with limited authority (ADLA).&nbsp;<\/p>\n\n\n\n<p>Based in Harare, Access Forex deals with the movement of money from South Africa, the UK and Zimbabwe. <\/p>\n\n\n\n<p>The FIC Act gives the SARB the mandate to ensure that ADLAs have adequate controls in place to combat acts of money laundering and the financing of terrorism.\u00a0<\/p>\n\n\n\n<p>Due to these responsibilities, the SARB inspects ADLAs to assess whether they have appropriate measures, as FIC requires.&nbsp;<\/p>\n\n\n\n<p>The SARB said that the administrative sanctions were imposed because of specific weaknesses that were detected in Access Forex&#8217;s control measures that inhibited it. <\/p>\n\n\n\n<p>It also failed to reflect essential provisions of the FIC Act in its Risk Management and Compliance Programme (RMCP) document.&nbsp;<\/p>\n\n\n\n<p>The company also failed to verify and identify some of its customers and provide adequate training to its staff members.<\/p>\n\n\n\n<p>With this, the SARB imposed the following&nbsp; administrative sanctions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A financial penalty of R100,000.00 for failure to comply with the provisions of section 42 (1) of the FIC Act;&nbsp;<\/li>\n\n\n\n<li>A financial penalty of R37,500 for failure to comply with the provisions of section 20; and&nbsp;<\/li>\n\n\n\n<li>A financial penalty of R25,000 for failure to comply with the provisions of section 43 of the FIC Act.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Joins a growing list<\/h2>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/06\/South-African-Reserve-Bank-e1750845292615.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"577\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/06\/South-African-Reserve-Bank-e1750845292615-1024x577.jpg\" alt=\"\" class=\"wp-image-829372\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/06\/South-African-Reserve-Bank-e1750845292615-1024x577.jpg 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/06\/South-African-Reserve-Bank-e1750845292615-300x169.jpg 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/06\/South-African-Reserve-Bank-e1750845292615-768x433.jpg 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2025\/06\/South-African-Reserve-Bank-e1750845292615.jpg 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/figure><\/div>\n\n\n<p><br>Sanctions have become common in South Africa over the last year, with the SARB and the Financial Sector Conduct Authority dishing out punishments to major banks and other financial institutions.&nbsp;<\/p>\n\n\n\n<p>Earlier this week, Sanlam Collective Investments (SCI) was fined by the Financial Sector Conduct Authority (FSCA) for breaching the FIC. This was due to multiple failures in its RMCP.&nbsp;<\/p>\n\n\n\n<p>The FSCA recognised the remedial steps taken by SCI from a prior sanction, and agreed to suspend R3.6 million of the R10.6 million fine for two years.&nbsp;<\/p>\n\n\n\n<p>Big banks have had a challenging year, with the Prudential Authority (PA) of the SARB placing fines on <a href=\"http:\/\/google.com\/search?q=capitec+businesstech+fine&amp;sca_esv=48ce434805bc8b69&amp;biw=1920&amp;bih=992&amp;tbm=nws&amp;ei=V0_yaLObJLOrhbIPg-L24Qg&amp;ved=0ahUKEwjzoqnZtauQAxWzVUEAHQOxPYwQ4dUDCA4&amp;uact=5&amp;oq=capitec+businesstech+fine&amp;gs_lp=Egxnd3Mtd2l6LW5ld3MiGWNhcGl0ZWMgYnVzaW5lc3N0ZWNoIGZpbmUyBRAhGKABMgUQIRigATIFECEYoAEyBRAhGKABSKwIUMIBWLsHcAB4AJABAJgB1wKgAfwJqgEDMy00uAEDyAEA-AEBmAIEoAKNCsICBhAAGA0YHsICCxAAGIAEGIYDGIoFwgIIEAAYgAQYogTCAgUQABjvBcICBhAAGBYYHsICBxAhGKABGArCAgQQIRgVmAMAiAYBkgcDMy00oAeTG7IHAzMtNLgHjQrCBwUwLjMuMcgHCA&amp;sclient=gws-wiz-news\">Capitec, Standard Bank, Absa<\/a> and many more.&nbsp;<\/p>\n\n\n\n<p>At the end of 2024, the PA imposed administrative sanctions on Capitec for multiple failures to comply with the FIC Act, following inspections in 2021 and 2022.&nbsp;<\/p>\n\n\n\n<p>These failings led to administrative sanctions comprising seven cautions, one reprimand, and a financial penalty of R56.25 million, of which R10.5 million is conditionally suspended for three years.&nbsp;<\/p>\n\n\n\n<p>Moreover, the PA also sanctioned Standard Bank for significant non-compliance with the FIC Act, which was identified during a 2022 inspection.\u00a0<\/p>\n\n\n\n<p>South Africa\u2019s largest bank by assets under management failed to conduct ongoing due diligence on two major clients, with no reviews done in 2018 or 2019.&nbsp;<\/p>\n\n\n\n<p>In response, the PA issued six cautions and levied a financial penalty of R13 million.&nbsp;<\/p>\n\n\n\n<p>Absa was hit with a fine in April 2025 following an inspection in 2022 that found&nbsp;several breaches of the FIC Act. <\/p>\n\n\n\n<p>The PA found deficiencies in Absa\u2019s customer due diligence procedures, particularly regarding foreign and domestic politically exposed persons and prominent influential persons. <\/p>\n\n\n\n<p>Absa was hit by two cautions, one reprimand, and a financial penalty of R10 million, split into R7 million for due diligence failures and R3 million for lapses in transaction monitoring.&nbsp;<\/p>\n\n\n\n<p>Several other <a href=\"https:\/\/www.google.com\/search?q=bank+of+taiwan+businesstech&amp;oq=bank+of+taiwan+businesstech&amp;gs_lcrp=EgZjaHJvbWUyBggAEEUYOdIBCDM1NjdqMGo0qAIAsAIB&amp;sourceid=chrome&amp;ie=UTF-8\">international banks<\/a>, including HSBC, HBZ Bank Limited, Citibank and Bank of Taiwan, have also been given fines over the last year.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Access Forex has become the latest company to be fined by regulatory officials in South Africa. <\/p>\n","protected":false},"author":95,"featured_media":806134,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[9872],"tags":[29,23839,22961,1798,5200,5368,3619,23840,499],"class_list":["post-840290","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-business","tag-absa","tag-access-forex","tag-bank-of-taiwan","tag-capitec","tag-citibank","tag-hsbc","tag-sarb","tag-sci","tag-standard-bank"],"_links":{"self":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/840290","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/users\/95"}],"replies":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/comments?post=840290"}],"version-history":[{"count":8,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/840290\/revisions"}],"predecessor-version":[{"id":840300,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/840290\/revisions\/840300"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media\/806134"}],"wp:attachment":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media?parent=840290"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/categories?post=840290"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/tags?post=840290"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
