{"id":842104,"date":"2025-11-05T17:40:54","date_gmt":"2025-11-05T15:40:54","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=842104"},"modified":"2025-11-05T18:16:57","modified_gmt":"2025-11-05T16:16:57","slug":"vodacom-vs-makate-please-call-me-battle-is-over","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/business\/842104\/vodacom-vs-makate-please-call-me-battle-is-over\/","title":{"rendered":"Vodacom vs Makate Please Call Me battle is over"},"content":{"rendered":"\n<p>Vodacom has announced that it has finally settled the Please Call Me matter with idea-man Kenneth Makate, reaching an out-of-court agreement\u2014the details of which were not revealed.<\/p>\n\n\n\n<p>In a late-day announcement to shareholders on Wednesday (5 November), Vodacom said that its board approved the settlement agreement and that the matter will not continue in the courts.<\/p>\n\n\n\n<p>The terms of the agreement were not revealed, with Vodacom saying only that it will be accounted for in the group&#8217;s interim results for the six month period ended 30 September 2025.<\/p>\n\n\n\n<p>&#8220;The parties are glad that finality has been reached in this regard,&#8221; Vodacom said.<\/p>\n\n\n\n<p>As part of the settlement process, a notice was sent to the Supreme Court of Appeal withdrawing Vodacom&#8217;s appeal. <\/p>\n\n\n\n<p>Additionally, a notice was sent to the High Court to abandon the 8 February 2022 judgment.<\/p>\n\n\n\n<p>Makate and Vodacom have been fighting over the former\u2019s Please Call Me idea for over two decades.<\/p>\n\n\n\n<p>Makate has been calling for fair compensation for \u201cinventing\u201d the Please Call Me service, which he believed should amount to almost R10 billion.<\/p>\n\n\n\n<p>Vodacom argued against this, saying that fair compensation for his contribution to the service would be around R50 million.<\/p>\n\n\n\n<p>Makate has maintained that he originated the idea for a free missed-call service that would allow customers to get their contacts\u2019 attention without using airtime.<\/p>\n\n\n\n<p>He shared the idea with his superior at Vodacom in 2001, where he said he was promised compensation.<\/p>\n\n\n\n<p>When this did not follow through, he launched a legal battle against Vodacom in 2008, seeking payment.<\/p>\n\n\n\n<p>The matter escalated to the Constitutional Court, where it previously ordered Vodacom to pay Makate fairly for his idea.<\/p>\n\n\n\n<p>Following the ruling, Vodacom increased its initial offer of compensation from R10 million to R47 million, which Makate rejected, returning to courts.<\/p>\n\n\n\n<p>In the second round of legal battles, the High Court ruled in Makate\u2019s favour for more compensation, which Vodacom rejected, taking Makate to the SCA.<\/p>\n\n\n\n<p>The Supreme Court dismissed Vodacom\u2019s appeal and then ordered the telco giant to compensate Makate between 5% and 7.5% of the revenue generated by the Please Call Me service over 18 years.<\/p>\n\n\n\n<p>An analysis by MyBroadband revealed that this would have resulted in a payment anywhere between R29 billion and R55 billion, depending on which data was used to calculate the share.<\/p>\n\n\n\n<p>However, Makate later claimed he only wanted R9.7 billion for the idea.<\/p>\n\n\n\n<p>Vodacom escalated the matter again to the Constitutional Court, arguing that the SCA had erred in its findings, unquestioningly using data submitted by Makate\u2019s team to draw its conclusions.<\/p>\n\n\n\n<p>The Constitutional Court handed down a scathing judgement against the SCA&#8217;s ruling, saying that the SCA failed to allow for a fair trial by ignoring Vodacom&#8217;s inputs and submissions.<\/p>\n\n\n\n<p>The ConCourt ordered that the matter go back to the SCA for a rerun and for a differently constituted party of judges to hear the case.<\/p>\n\n\n\n<p>Following the settlement agreement, this will no longer be happening.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Vodacom has announced that it has finally settled the Please Call Me matter with idea-man Kenneth Makate, reaching an out-of-court agreement<\/p>\n","protected":false},"author":10,"featured_media":751822,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[9872],"tags":[24003,6442,27],"class_list":["post-842104","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-business","tag-kenneth-makate","tag-please-call-me","tag-vodacom"],"_links":{"self":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/842104","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/users\/10"}],"replies":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/comments?post=842104"}],"version-history":[{"count":3,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/842104\/revisions"}],"predecessor-version":[{"id":842121,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/842104\/revisions\/842121"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media\/751822"}],"wp:attachment":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media?parent=842104"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/categories?post=842104"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/tags?post=842104"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
