warning for South Africans with dogs"},"content":{"rendered":"\n<p>While noisy neighbours can be incredibly frustrating, there are laws in South Africa that can help keep one\u2019s home peaceful.&nbsp;<\/p>\n\n\n\n<p>\u201cLate-night music, barking dogs, and even regular domestic rows are disturbances that can negatively impact your health and well-being,\u201d said legal expert Cor Van Deventer, Director at VDM Incorporated.<\/p>\n\n\n\n<p>One\u2019s right to a peaceful environment is still protected by the Environment Conservation Act and local municipal by-laws, but this depends on the type of noise.&nbsp;<\/p>\n\n\n\n<p>The first is disturbing noise, which can be measured in decibels, such as music, power tools, and machinery.&nbsp;<\/p>\n\n\n\n<p>The second is noise nuisance, which is more subjective and can refer to noise that disturbs the peace for an extended period, such as <strong>incessant barking from dogs.<\/strong><\/p>\n\n\n\n<p>Municipal by-laws often specify acceptable noise levels for different zones and times. <\/p>\n\n\n\n<p>One case, <em>Laskey and Another v Showzone CC and Others, <\/em>saw noise and other complaints made by residents about a theatre-restaurant in Cape Town.&nbsp;<\/p>\n\n\n\n<p>The court found that the respondent&#8217;s roof and roof gallery had not been acoustically insulated, and as a result, the respondent was prohibited from conducting business until effective measures were put in place.&nbsp;<\/p>\n\n\n\n<p>The first respondent was also directed to pay the applicants\u2019 legal expenses, including the costs incurred from setting the hearing down as a matter of urgency.<\/p>\n\n\n\n<p>Noise nuisance can include dogs that bark constantly, loud music, shouting, or frequent parties.&nbsp;<\/p>\n\n\n\n<p>The court will consider factors such as noise, duration, and the time and place it occurs.<\/p>\n\n\n\n<p>An extreme case was presented in the High Court, involving the City of Cape Town and a dog-related business.&nbsp;<\/p>\n\n\n\n<p>The business was found to be in breach of noise regulations, amid incessant barking that constituted a nuisance.&nbsp;<\/p>\n\n\n\n<p>The business was also granted a cease order, essentially meaning that it had to close down.&nbsp;<\/p>\n\n\n\n<p>\u201cIt&#8217;s important to realise that the law recognises that certain noise levels are part of communal living, especially in urban areas,\u201d said Van Deventer.&nbsp;<\/p>\n\n\n\n<p>\u201cBut when the noise becomes unreasonable, frequent, and disruptive, you have the right to take action.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What you can do&nbsp;<\/h2>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter \/><\/a><\/figure><\/div>\n\n\n<p>If you have a problem with noise levels, the best first step is to talk with your neighbour.&nbsp;<\/p>\n\n\n\n<p>If the neighbour is uncooperative or simply ignores a request, it may be best to take a formal approach.&nbsp;<\/p>\n\n\n\n<p>Options include sending a complaint to the local municipality, outlining the nuisance, citing the relevant by-laws and creating an official record that can be used later.&nbsp;<\/p>\n\n\n\n<p>\u201cThe process can, however, be slow and at times ineffective,\u201d warned Van Deventer.<\/p>\n\n\n\n<p>Another option is to approach a mediator, who can facilitate a structured discussion to help both parties reach a reasonable compromise, which can save time and minimise confrontation.&nbsp;<\/p>\n\n\n\n<p>The final recourse is to apply for a court interdict through an attorney.&nbsp;<\/p>\n\n\n\n<p>\u201cAn interdict is a powerful court order that legally compels your neighbour to stop the noise.\u201d&nbsp;<\/p>\n\n\n\n<p>\u201cTo do this, the application must contain evidence such as a detailed log of the noise incidents, witness statements, recordings, and a statement about the negative impact it\u2019s having on your life.\u201d<\/p>\n\n\n\n<p>If a neighbour ignores a court interdict, they may be held in contempt of court.
