{"id":855850,"date":"2026-04-05T13:00:00","date_gmt":"2026-04-05T11:00:00","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=855850"},"modified":"2026-04-02T18:53:47","modified_gmt":"2026-04-02T16:53:47","slug":"new-labour-laws-in-south-africa-have-a-serious-problem-for-pensions","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/business\/855850\/new-labour-laws-in-south-africa-have-a-serious-problem-for-pensions\/","title":{"rendered":"New labour laws in South Africa have a serious problem for pensions"},"content":{"rendered":"\n<p>The proposed changes to the Basic Conditions of Employment Act (BCEA) have raised concerns over pension fund payouts for members. <\/p>\n\n\n\n<p>Nicolette van Vuuren and&nbsp;Amy King from Webber Wentzel noted that two developments have reshaped the enforcement of retirement fund contribution obligations in South Africa.<\/p>\n\n\n\n<p>The first development is already in effect, while the second was just open for public comment ahead of its formal introduction to Parliament. <\/p>\n\n\n\n<p>In January 2026, the Minister of Employment and Labour withdrew a variation notice published in December 2003.<\/p>\n\n\n\n<p>That notice had excluded contributions payable to benefit funds regulated under the Pension Funds Act from the application of section 34A of the BCEA. <\/p>\n\n\n\n<p>Labour inspectors are empowered to enforce Section 34A, which requires employers to pay employee contributions to a benefit fund within seven days of deduction. <\/p>\n\n\n\n<p>This is done in conjunction with the employer&#8217;s contributions being paid within seven days of the end of the month.<\/p>\n\n\n\n<p>&#8220;This enforcement power is already operative and does not depend on the proposed amendments set out in the Employment Laws Amendment Bill, 2025,&#8221; the experts said. <\/p>\n\n\n\n<p>&#8220;The Bill, which proposes to insert new sections 62B and 77B into the BCEA, has not yet commenced.&#8221; <\/p>\n\n\n\n<p>If the Bill is enacted in its current form, these provisions will expand beyond the current enforcement framework. <\/p>\n\n\n\n<p>It would empower the Labour Court, the CCMA, and bargaining councils to issue mandatory orders and regulate the jurisdictional interplay among these bodies and Pension Funds Adjudicators.<\/p>\n\n\n\n<p>Section 62B states that an employer&#8217;s failure to pay contributions to a benefit fund for an employee must be treated the same as a failure to pay any amount owing to an employee. <\/p>\n\n\n\n<p>&#8220;The practical effect is that non-payment of benefit fund contributions will attract the same enforcement consequences as non-payment of wages or other statutory entitlements,&#8221; the legal experts said. <\/p>\n\n\n\n<p>Upon enactment, retirement funds will benefit from multiple concurrent enforcement channels, compliance orders and awards and determinations from official state bodies. <\/p>\n\n\n\n<p>This will make it easier for pension funds to collect monies owed to members from their employers following non-payment. <\/p>\n\n\n\n<p>Section 13A(8) also imposes personal liability on, among others, directors regularly involved in the management of a company&#8217;s financial affairs. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Major question remains <\/h2>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/meth-labour-2.jpeg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/meth-labour-2-1024x576.jpeg\" alt=\"\" class=\"wp-image-855873\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/meth-labour-2-1024x576.jpeg 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/meth-labour-2-300x169.jpeg 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/meth-labour-2-768x432.jpeg 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/meth-labour-2-1536x864.jpeg 1536w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/meth-labour-2.jpeg 1600w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/figure><\/div>\n\n\n<p>However, the experts noted that a major unresolved question remains over the misalignment of due dates for employee contributions under the two statutes. <\/p>\n\n\n\n<p>Section 34A of the BCEA and section 13A of the Pension Funds Act both require employer contributions to be paid within seven days after the end of the month. <\/p>\n\n\n\n<p>That said, provisions differ over employee contributions. Section 34A of the BCEA requires that these employee contributions be paid within seven days of deduction. <\/p>\n\n\n\n<p>However, Section 13A of the Pension Funds Act requires payment within seven days after the end of the month for which contributions are due. <\/p>\n\n\n\n<p>&#8220;Given the variation in payroll dates and pay frequencies across employers, this discrepancy creates material compliance risk,&#8221; the experts said. <\/p>\n\n\n\n<p>Section 77B of the BCEA regulates the jurisdiction of the Labour Court, the CCMA, and bargaining councils over issues regarding an employer&#8217;s failure to pay contributions under the Pension Funds Act. <\/p>\n\n\n\n<p>This is regardless of whether the obligation arises under statute, a collective agreement, or a contract of employment.<\/p>\n\n\n\n<p>&#8220;Where a contribution is found to be outstanding, the adjudicating body must direct payment to the fund within a specified period, together with prescribed interest.&#8221; <\/p>\n\n\n\n<p>&#8220;Jurisdiction is excluded if the Pension Funds Adjudicator has already issued a determination under section 30M of the Pension Funds Act, or if another tribunal or court of competent jurisdiction has adjudicated the matter.&#8221;<\/p>\n\n\n\n<p>The Bill also proposed amending Schedule 3 to the BCEA so that sections 62B and 77B apply immediately upon commencement to all unresolved disputes, irrespective of when they were referred.<\/p>\n\n\n\n<p>Although the historical exclusion of Pension Funds Act contributions from Labour Inspector oversight has been removed, the enforcement landscape has now been changed. <\/p>\n\n\n\n<p>Employers are now subject to enforcement action for the failure to pay contributions on time, and should the BCEA&#8217;s current amendments be enacted, the enforcement framework will be further strengthened. <\/p>\n\n\n\n<p>&#8220;Employers are therefore advised to ensure strict compliance with all contribution obligations and to seek legal advice promptly where any dispute has been referred or is contemplated.&#8221; <\/p>\n\n\n\n<p>Submissions for public comment on the new employment laws closed on 28 March, and the experts said that the technical concern over payments warrants engagement at the pre-parliamentary stage.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Experts from Webber Wentzel have highlighted concerns over technical issues related to the amendments to the Basic Conditions of Employment. <\/p>\n","protected":false},"author":95,"featured_media":855872,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[9872],"tags":[9455],"class_list":["post-855850","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-business","tag-webber-wentzel"],"_links":{"self":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/855850","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/users\/95"}],"replies":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/comments?post=855850"}],"version-history":[{"count":3,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/855850\/revisions"}],"predecessor-version":[{"id":855881,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/855850\/revisions\/855881"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media\/855872"}],"wp:attachment":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media?parent=855850"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/categories?post=855850"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/tags?post=855850"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
