{"id":856311,"date":"2026-04-08T16:08:32","date_gmt":"2026-04-08T14:08:32","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=856311"},"modified":"2026-04-08T16:08:35","modified_gmt":"2026-04-08T14:08:35","slug":"massive-changes-coming-for-visa-and-immigration-rules-in-south-africa","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/government\/856311\/massive-changes-coming-for-visa-and-immigration-rules-in-south-africa\/","title":{"rendered":"Massive changes coming for visa and immigration rules in South Africa"},"content":{"rendered":"\n<p>The Cabinet has approved the Updated White Paper on Citizenship, Immigration, and Refugee Protection (CIRP), marking one of the most intricate and significant governance initiatives of the democratic period.<\/p>\n\n\n\n<p>The version of the White Paper approved by the Cabinet confirms that the fundamental policy principles outlined in the draft released for public feedback in December 2025 remain largely unchanged.<\/p>\n\n\n\n<p>&#8220;The approval of the Revised White Paper by Cabinet marks another important milestone on our journey to fundamentally reform South Africa\u2019s civil and immigration systems,&#8221; said Home Affairs Minister Leon Schreiber.<\/p>\n\n\n\n<p>&#8220;The policy direction outlined in the White Paper charts a new course for our country to build modern, efficient and secure systems that serve South Africa\u2019s interests,&#8221; he said.<\/p>\n\n\n\n<p>The Department of Home Affairs (DHA) is now moving forward with drafting and presenting the necessary legislative amendments to enact the policy in Parliament.<\/p>\n\n\n\n<p>Xpatweb Managing Director Marisa Jacobs said that the approved White Paper places economic contribution as an important factor in immigration policy.<\/p>\n\n\n\n<p>One of the biggest proposed changes is that work visas and permanent residency be evaluated based on economic merit, and that citizenship prioritises measurable contributions to South Africa.<\/p>\n\n\n\n<p>The DHA emphasised that citizenship decisions should not be arbitrary but granted to individuals who demonstrate a commitment to the economic and social development of South Africa.<\/p>\n\n\n\n<p>Applicants with critical skills\u2014those who create jobs, invest in businesses, or contribute to economic growth\u2014will receive higher scores under the points-based system. <\/p>\n\n\n\n<p>Jacobs described this as a positive step towards enhancing South Africa\u2019s economic growth and enabling businesses to attract the skills needed to build a sustainable nation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">New White Paper developments<\/h2>\n\n\n\n<figure class=\"wp-block-image size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/Leon-Schreiber-1.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/Leon-Schreiber-1-1024x576.jpg\" alt=\"\" class=\"wp-image-856337\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/Leon-Schreiber-1-1024x576.jpg 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/Leon-Schreiber-1-300x169.jpg 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/Leon-Schreiber-1-768x432.jpg 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/Leon-Schreiber-1-1536x864.jpg 1536w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/Leon-Schreiber-1.jpg 1600w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/figure>\n\n\n\n<p>Another development from the approved White Paper is the relaxation of restrictions for spouses of skilled visa holders. <\/p>\n\n\n\n<p>In the past, the exclusion of spouses from the labour market made South Africa less attractive to global talent.<\/p>\n\n\n\n<p>The new policy now permits spouses of skilled worker visa holders to seek work authorisation through a points-based system, with certain requirements eased.<\/p>\n\n\n\n<p>Although this change does not provide automatic work rights, it creates a clearer and more practical route to employment. <\/p>\n\n\n\n<p>Jacobs pointed out that this is a significant shift in improving South Africa&#8217;s competitiveness in attracting rare skills.<\/p>\n\n\n\n<p>Traditionally, the absence of a straightforward pathway for spouses to work has made South Africa a less appealing option for foreign professionals with valuable skills, considering overseas assignments.<\/p>\n\n\n\n<p>&#8220;Many accompanying spouses are themselves highly skilled, representing an untapped economic benefit for&nbsp;South Africa,&#8221; she said.<\/p>\n\n\n\n<p>However, the Revised White Paper implements stricter regulations regarding the Retired Person Visa.<\/p>\n\n\n\n<p>Previously, there was no minimum age requirement, leading to approvals for applicants as young as 25.
