{"id":857778,"date":"2026-04-28T07:01:43","date_gmt":"2026-04-28T05:01:43","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=857778"},"modified":"2026-04-28T07:01:43","modified_gmt":"2026-04-28T05:01:43","slug":"sars-coming-after-south-africans-moving-money-out-the-country","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/finance\/857778\/sars-coming-after-south-africans-moving-money-out-the-country\/","title":{"rendered":"SARS coming after South Africans moving money out the country"},"content":{"rendered":"\n<p>The South African Revenue Service (SARS) is cracking down on offshore money transfers under new exchange control rules.<\/p>\n\n\n\n<p>This means that South Africans living abroad are facing a far stricter environment when trying to move money out of the country.<\/p>\n\n\n\n<p>Under the new exchange control framework, banks now require an Approval of International Transfer (AIT) before funds can be transferred.<\/p>\n\n\n\n<p>Speaking in an <a href=\"https:\/\/iono.fm\/e\/1666308\" target=\"_blank\" rel=\"noreferrer noopener\">interview<\/a>, Jonty Leon, managing partner at Leap Group\u2014an international tax compliance firm\u2014warned that without it, transfers can be stopped and accounts effectively frozen.<\/p>\n\n\n\n<p>According to Leon, the shift is intentional. \u201cI think it is both a compliance clean-up, as well as a bit of an enforcement mechanism that SARS is now using,\u201d he said.<\/p>\n\n\n\n<p>He added that SARS wants to ensure that all taxpayers are compliant and that they\u2019re extracting every last bit of taxpayer money possible.<\/p>\n\n\n\n<p>\u201cUnder the old system, all you needed was a good-standing tax clearance certificate, and you were able to move funds abroad,\u201d Leon said.<\/p>\n\n\n\n<p>\u201cUnder the new system, the AIT is not just a form that needs to be filled out, but it\u2019s an entire application process where SARS is able to dig into all of your affairs before they will allow you to move money out of the country.\u201d<\/p>\n\n\n\n<p>He warned that a major risk is that many expats may not realise how exposed they are\u2014particularly regarding their tax residency status with SARS.<\/p>\n\n\n\n<p>\u201cThe majority of South Africans that we deal with are outside of South Africa and may have been outside for many years,\u201d he said.&nbsp;<\/p>\n\n\n\n<p>\u201cHowever, with the AIT application, you have to declare to SARS if you are a resident or non-resident, and this makes a massive difference.\u201d<\/p>\n\n\n\n<p>Leon explained that if you\u2019re a tax resident of South Africa, SARS can look into your local income and assets, as well as your foreign income and assets.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Banks are freezing accounts <\/h2>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/Jonty-Leon.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/Jonty-Leon-1024x576.jpg\" alt=\"\" class=\"wp-image-857789\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/Jonty-Leon-1024x576.jpg 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/Jonty-Leon-300x169.jpg 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/Jonty-Leon-768x432.jpg 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/Jonty-Leon-1536x864.jpg 1536w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/04\/Jonty-Leon.jpg 1600w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><figcaption class=\"wp-element-caption\"><em>Jonty Leon, managing partner at Leap Group.<\/em><\/figcaption><\/figure><\/div>\n\n\n<p>If you\u2019re a non-resident, they can only look at your South African income and assets. The danger comes when individuals are incorrectly classified.&nbsp;<\/p>\n\n\n\n<p>\u201cIf you are not noted correctly as a non-resident and you go and apply for an AIT, all of a sudden you\u2019ve opened yourself up to SARS looking at your entire estate across the world,\u201d Leon warned.<\/p>\n\n\n\n<p>He added that many South Africans abroad may be operating under a false sense of security.&nbsp;<\/p>\n\n\n\n<p>\u201cEvery single one of our clients is someone who has realised that they aren\u2019t actually compliant,\u201d he said. For those caught out, the consequences can be severe.&nbsp;<\/p>\n\n\n\n<p>\u201cIt gets quite scary for taxpayers abroad because they may have been there for many years, and now they\u2019ve got the worry that SARS wants to tax them on everything they\u2019ve been building outside of South Africa.\u201d<\/p>\n\n\n\n<p>Banks are also playing a far more active role in enforcement when individuals try to move money offshore.<\/p>\n\n\n\n<p>\u201cIf you try to move money outside of South Africa, but you don\u2019t have the requisite approval from SARS, banks are now required to freeze your account,\u201d he said.&nbsp;<\/p>\n\n\n\n<p>\u201cThis until such time as you are fully compliant,\u201d adding that this is happening quite often now.
