{"id":861612,"date":"2026-06-07T16:00:00","date_gmt":"2026-06-07T14:00:00","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=861612"},"modified":"2026-06-05T14:08:32","modified_gmt":"2026-06-05T12:08:32","slug":"warning-to-anyone-from-another-country-working-in-south-africa","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/government\/861612\/warning-to-anyone-from-another-country-working-in-south-africa\/","title":{"rendered":"Warning to anyone from another country working in South Africa"},"content":{"rendered":"\n<p>South Africa\u2019s recently approved Immigration White Paper marks one of the most significant changes to immigration policy in decades.<\/p>\n\n\n\n<p>For many highly skilled foreign nationals currently employed in the country, it may be wise to consider applying for permanent residency sooner rather than later.<\/p>\n\n\n\n<p>South Africa&#8217;s Immigration White Paper is a government plan designed to completely overhaul and modernise the country&#8217;s immigration laws.&nbsp;<\/p>\n\n\n\n<p>This plan reportedly aims to balance stricter border security and asylum rules while simplifying the visa process for skilled workers and digital nomads to boost the economy.&nbsp;<\/p>\n\n\n\n<p>Since this is a policy plan rather than a law, the government is currently working to turn these proposals into bills for Parliament to debate and vote on.<\/p>\n\n\n\n<p>Expat expert Xpatweb said the White Paper contains several positive, much-needed reforms, including greater digitisation, expanding the Trusted Employer Scheme, and modernising immigration systems.<\/p>\n\n\n\n<p>However, they also said that it points to a potentially more restrictive future approach to permanent residence (\u201cPR\u201d).<\/p>\n\n\n\n<p>Xpatweb Managing Director Marisa Jacobs said that the proposed changes should prompt strategic planning for employers and foreign professionals alike.<\/p>\n\n\n\n<p>\u201cThe White Paper clearly indicates a policy shift toward tighter control over permanent residence approvals, particularly for highly skilled foreign nationals who currently have more direct pathways available under existing legislation,\u201d said Jacobs.<\/p>\n\n\n\n<p>The proposals currently under discussion include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Submitting Permanent Residency (PR) applications through a window-based system.<\/li>\n\n\n\n<li>Extending the qualifying period before individuals become eligible for PR.<\/li>\n\n\n\n<li>Bigger focus on economic contributions through a Points-Based approach.<\/li>\n\n\n\n<li>Allowing greater state discretion in determining approval volumes (quotas).<\/li>\n<\/ul>\n\n\n\n<p>While the White Paper is not yet law, it has been approved by Parliament and strongly indicates the direction that future legislation may take.<\/p>\n\n\n\n<p>Jacobs said that many employers overlook the strategic importance of permanent residence when managing international talent.<\/p>\n\n\n\n<p>\u201cFor multinational employers, permanent residence reduces long-term immigration risk, removes ongoing visa renewal uncertainty and strengthens retention of scarce and highly skilled talent,\u201d said Jacobs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Permanent residency in South Africa<\/h2>\n\n\n\n<p>\u201cSouth Africa welcomes immigrants who are in a position to make a meaningful contribution to broadening the economic base of South Africa,\u201d the government wrote on its website.<\/p>\n\n\n\n<p>\u201cBefore you can apply for a permanent residency permit, you must first motivate why you should not&nbsp; be declared a prohibited person or an undesirable person.\u201d<\/p>\n\n\n\n<p>To qualify for a direct permanent residence permit in South Africa, the applicant and their spouse must have lived in the country on a work permit for a minimum of five years.&nbsp;<\/p>\n\n\n\n<p>Additionally, dependents of South African citizens or holders of permanent residence permits are also eligible to apply.<\/p>\n\n\n\n<p>Residency on other grounds applies to foreigners who:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Possess a permanent job offer in South Africa<\/li>\n\n\n\n<li>Have exceptional skills and qualifications<\/li>\n\n\n\n<li>Intend to establish a business in South Africa<\/li>\n\n\n\n<li>Qualify as refugees under Section 27(c) of the Refugees Act<\/li>\n\n\n\n<li>Qualify as retired persons<\/li>\n\n\n\n<li>Are financially independent, or<\/li>\n\n\n\n<li>Are relatives (either by blood or judicial adoption) of a South African citizen or a permanent residence permit holder.<\/li>\n<\/ul>\n\n\n\n<p>The main distinction between a South African citizen and a permanent resident is that citizens possess a South African passport and have the right to vote in all elections.<\/p>\n\n\n\n<p>In contrast, permanent residents can live, work, and study in South Africa indefinitely, but they remain foreign nationals and must travel using their home country&#8217;s passport.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><div class=\"table-responsive\"><table class=\"table\" class=\"has-fixed-layout\"><thead><tr><td><strong>Feature<\/strong><\/td><td><strong>South African Citizen<\/strong><\/td><td><strong>Permanent Resident<\/strong><\/td><\/tr><\/thead><tbody><tr><td><strong>Passports &amp;
