This is despite hundreds of stores and boutiques operating across and in major shopping malls.&nbsp;<\/p>\n\n\n\n<p>Speaking in an interview with <a href=\"https:\/\/www.youtube.com\/watch?v=29wnmDVcRg4\" target=\"_blank\" rel=\"noreferrer noopener\">702 Drive<\/a>, specialist cannabis and environmental lawyer at Cullinan &amp; Associates, Paul-Michael Keichel, said South Africa\u2019s cannabis laws are absolutely clear, but they seem to have confused everybody.<\/p>\n\n\n\n<p>He argued that the rapid spread of cannabis dispensaries and retail stores has created a widespread misconception that selling cannabis is legal.<\/p>\n\n\n\n<p>According to Keichel, much of the confusion stems from the 2018 Constitutional Court judgment on private cannabis use, combined with the fact that the Cannabis for Private Purposes Act, enacted in 2024, has not been operationalised.<\/p>\n\n\n\n<p>As a result, he stressed that cannabis remains regulated under the Drugs and Drug Trafficking Act, which \u201csays that any trade in cannabis is illegal and could land you in prison.\u201d<\/p>\n\n\n\n<p>Keichel explained that the current legal framework does not authorise general commercial cannabis sales.&nbsp;<\/p>\n\n\n\n<p>\u201cThe only exception to being deemed a drug dealer is if you hold a licence in terms of the Medicines Act, read together with the Pharmacy Act,\u201d he said.<\/p>\n\n\n\n<p>This refers to registered medicinal cannabis products dispensed through the appropriate regulatory channels.<\/p>\n\n\n\n<p>He noted that the Cannabis for Private Purposes Act does not legalise cannabis retailing but instead \u201cforeshadows\u201d a future regulatory system.&nbsp;<\/p>\n\n\n\n<p>This means the government could still introduce legislation, such as amendments to the Business Act or an entirely new commercial cannabis law, that would legitimise the industry.<\/p>\n\n\n\n<p>Despite cannabis stores appearing on every street corner, Keichel believes the expansion reflects government delays rather than legal certainty.&nbsp;<\/p>\n\n\n\n<p>\u201cSome of the blame needs to go towards government inaction,\u201d he said, pointing out that Parliament took around five years to pass the Cannabis for Private Purposes Act after being given a two-year deadline following the 2018 judgment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Possibility of prosecution <\/h2>\n\n\n\n<figure class=\"wp-block-image size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/06\/cannabis-1-1.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/06\/cannabis-1-1-1024x576.jpg\" alt=\"\" class=\"wp-image-864504\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/06\/cannabis-1-1-1024x576.jpg 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/06\/cannabis-1-1-300x169.jpg 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/06\/cannabis-1-1-768x432.jpg 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/06\/cannabis-1-1-1536x864.jpg 1536w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/06\/cannabis-1-1.jpg 1600w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/figure>\n\n\n\n<p>He also noted that President Cyril Ramaphosa has repeatedly promised to accelerate cannabis liberalisation in successive State of the Nation Addresses, with nothing to come of it.&nbsp;<\/p>\n\n\n\n<p>Keichel argued that many entrepreneurs have simply stopped waiting for legislative reform. \u201cWhat you\u2019re actually seeing is a whole lot of people who want to make money out of cannabis who are just done with waiting and are pushing ahead despite knowing that it\u2019s illegal.\u201d<\/p>\n\n\n\n<p>He also said enforcement has become inconsistent, and many members of the South African Police Service are too busy with other things and have given up on enforcing cannabis.<\/p>\n\n\n\n<p>In his view, officers \u201cactually don\u2019t care anymore, either that or they are being bribed to turn a blind eye,\u201d although he added that this varies by jurisdiction and must be assessed on a case-by-case basis.<\/p>\n\n\n\n<p>If police were to launch a coordinated crackdown on cannabis retailers, Keichel believes prosecutions would be relatively straightforward under existing legislation.&nbsp;<\/p>\n\n\n\n<p>\u201cI think it would be a very easy prosecution, and you could face more than a large fine. You could face many years in prison,\u201d he said.&nbsp;<\/p>\n\n\n\n<p>While he questioned whether the government has a \u201ccoherent or reliable policy when it comes to cannabis,\u201d Keichel warned that the lack of regulation creates consumer risks beyond legal uncertainty.<\/p>\n\n\n\n<p>\u201cWhat we\u2019re really lacking in this instance is regulated quality control.
