{"id":866973,"date":"2026-08-15T07:00:00","date_gmt":"2026-08-15T05:00:00","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=866973"},"modified":"2026-08-15T08:31:40","modified_gmt":"2026-08-15T06:31:40","slug":"wake-up-call-for-anyone-living-in-complexes-and-estates-in-south-africa","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/property\/866973\/wake-up-call-for-anyone-living-in-complexes-and-estates-in-south-africa\/","title":{"rendered":"Wake-up call for anyone living in complexes and estates in South Africa"},"content":{"rendered":"\n<p>Community schemes, developers, and owners lost two high-stakes financial disputes before the merits were even considered\u2014all because of two avoidable errors.<\/p>\n\n\n\n<p>These errors were cases that lacked legal standing and relied on unsubstantiated allegations rather than objective, audited evidence.<\/p>\n\n\n\n<p>The cases were shot down by the Community Schemes Ombud Service (CSOS).<\/p>\n\n\n\n<p>CSOS is South Africa\u2019s statutory dispute resolution body for sectional title schemes, homeowners&#8217; associations, share\u2011block schemes, and other community\u2011scheme governance structures. <\/p>\n\n\n\n<p>It was created under the Community Schemes Ombud Service Act, 2011, it has jurisdiction over things like financial disputes, governance and administrative conflicts, scheme\u2011rule enforcement and others.<\/p>\n\n\n\n<p>According to Erin Sutton, Community Schemes Law Specialist at Van Deventer Dowlath &amp; Marx Incorporated, the two cases sent for adjudication by CSOS uncovered fatal flaws in how community schemes approach CSOS.<\/p>\n\n\n\n<p>\u201cThe cases highlight the two gatekeepers that determine whether a matter will be heard at all: legal standing and objective evidence,\u201d she said.<\/p>\n\n\n\n<p>She warned that CSOS isn\u2019t a catch\u2011all complaint desk or an investigative body, but rather a legal forum that requires applicants to have standing and evidence, or they won\u2019t be heard.<\/p>\n\n\n\n<p>When it comes to standing, the first case involved a developer who disputed R419,000 in interest paid under protest to obtain a levy clearance certificate.<\/p>\n\n\n\n<p>The dispute related to a right of extension\u2014a developer&#8217;s right to build additional phases at a later stage.<\/p>\n\n\n\n<p>Sutton noted that, despite the financial stakes, the CSOS adjudicator dismissed the matter outright because the developer didn&#8217;t even meet the definition of an &#8216;owner&#8217; or &#8216;occupier&#8217;.<\/p>\n\n\n\n<p>In short, the case had no standing in the Act, so it couldn&#8217;t even be brought.<\/p>\n\n\n\n<p>\u201cIf an applicant does not fall within the narrow definitions of Section 38 and Section 1 of the CSOS Act, the forum cannot hear the dispute. Standing is the first gatekeeper, and it is absolute,&#8221; she said.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Allegations vs Evidence<\/h2>\n\n\n\n<figure class=\"wp-block-image size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/07\/Erin-Sutton.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/07\/Erin-Sutton-1024x576.jpg\" alt=\"\" class=\"wp-image-866988\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/07\/Erin-Sutton-1024x576.jpg 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/07\/Erin-Sutton-300x169.jpg 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/07\/Erin-Sutton-768x432.jpg 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/07\/Erin-Sutton.jpg 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><figcaption class=\"wp-element-caption\">Erin Sutton, Community Schemes Law Specialist at Van Deventer Dowlath &amp; Marx Incorporated<\/figcaption><\/figure>\n\n\n\n<p>The second case involved owners who alleged that up to 80% of scheme expenditure had been irregularly channelled through a Master HOA, thereby creating an inequitable levy burden.<\/p>\n\n\n\n<p>They also accused the developer of avoiding contribution obligations linked to its Section 25 real rights.<\/p>\n\n\n\n<p>Unfortunately, the respondents nullified these claims with objective, independently verified evidence, again, ending the matter swiftly.<\/p>\n\n\n\n<p>They presented audited annual financial statements, already adopted at AGMs\u2014which carry decisive legal weight, and cannot be overridden without proof of fraud or systemic error.<\/p>\n\n\n\n<p>They also presented an independent compliance audit confirming full regulatory adherence and intact statutory records.<\/p>\n\n\n\n<p>&#8220;With no verifiable data to counter the audited financials, the applicants\u2019 allegations collapsed,&#8221; Sutton said.<\/p>\n\n\n\n<p>\u201cEvidence is the second gatekeeper,\u201d she said. <\/p>\n\n\n\n<p>The legal expert said that CSOS decides matters on a balance of probabilities. Therefore, unverified percentages, assumptions, or sweeping claims cannot outweigh audited financials and independent compliance reports.<\/p>\n\n\n\n<p>Viewed together, Sutton said the CSOS rulings establish a definitive framework for anyone approaching it with a financial dispute:<\/p>\n\n\n\n<p>First, have<strong> standing: <\/strong>Applicants must fall squarely within the statutory definitions of the CSOS Act. Developers, overarching entities, and third parties must verify their eligibility before filing.<\/p>\n\n\n\n<p>Second, have <strong>substance: <\/strong>Any challenge to levy structures, interest charges, or alleged misallocated expenses must be supported by quantified expert reports or mathematical proof.
