A recent Gauteng High Court judgment has warned retirement villages and estates in South Africa that a strict reading of contracts may not be enough to evict surviving spouses from their homes.<\/p>\n\n\n\n

According to law firm Cliffe Dekker Hofmeyr (CDH), the ruling highlighted the importance of considering the purpose of retirement housing agreements.<\/p>\n\n\n\n

This includes the circumstances surrounding them and the protections provided by South African law.<\/p>\n\n\n\n

The case involved a 78-year-old widower, who faced eviction from his home after the death of his wife, Adriana Catharina Botha.<\/p>\n\n\n\n

In August 2010, the woman signed an agreement with a company that operates retirement villages, granting her a lifetime right to occupy a unit for the rest of her life.<\/p>\n\n\n\n

At the time, she was divorced, so the section of the agreement dealing with a spouse was left blank. She later married a man in March 2019, and he moved into the retirement village shortly afterwards.<\/p>\n\n\n\n

The retirement village management knew he was living there and accepted his occupation without requiring the agreement to be amended.<\/p>\n\n\n\n

Following Botha’s death in September 2023, the retirement village instructed the man to vacate the property, and argued that because his details had never been formally added to the agreement, he had no legal right to remain there.<\/p>\n\n\n\n

After he refused to leave, the retirement village approached the Gauteng High Court in Johannesburg for an eviction order under the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act (PIE Act).<\/p>\n\n\n\n

The court first had to determine whether the agreement allowed the man to continue living in the unit despite not being listed as a spouse when the contract was signed.<\/p>\n\n\n\n

In considering this question, the court adopted what CDH described as a contextual approach rather than relying solely on the agreement’s wording.<\/p>\n\n\n\n

The judgment stated that “interpretation is a unitary exercise in which the language used must be considered in the light of its context and purpose.”<\/p>\n\n\n\n

The court noted that the retirement village had long known the man was living with the woman and had never objected or insisted that the agreement be updated.<\/p>\n\n\n\n

It also found that, while the contract allowed changes to a spouse’s details, it did not address the situation where someone was unmarried when signing the agreement but later married.<\/p>\n\n\n\n

The retirement village argued that the client should have cancelled the original agreement and signed a completely new one after getting married.<\/p>\n\n\n\n

However, the court found that neither the agreement nor the governing rules of the retirement scheme supported that interpretation.<\/p>\n\n\n\n

The court also considered the Housing Development Schemes for Retired Persons Act, which governs retirement housing schemes.<\/p>\n\n\n\n

Under Section 7(1), the Act grants occupation rights to the spouse of a person who holds an interest in a retirement scheme.<\/p>\n\n\n\n

Taking all these factors into account, the court concluded that the requirement to record a spouse’s details was primarily administrative.<\/p>\n\n\n\n

It found that failing to update the agreement did not prevent the man from benefiting from his late wife’s life rights, meaning he remained a lawful occupier.<\/p>\n\n\n\n

Even after reaching that conclusion, the court went a step further by considering whether eviction would have been fair if the man had technically been regarded as an unlawful occupier. It found that this was not the case.<\/p>\n\n\n\n

The court considered the man’s age, poor health, limited income and inability to secure alternative accommodation.<\/p>\n\n\n\n

It also recognised that he had lived in the home for several years and that it had become his primary residence.<\/p>\n\n\n\n

Although the retirement village argued that his continued occupation delayed the winding up of the deceased estate and prevented the property from being sold, the court found that these concerns were largely financial and administrative.<\/p>\n\n\n\n

It also noted that the eviction application had not been brought by the executor of the deceased’s estate. The court therefore dismissed the eviction application, finding that it would not be “just and equitable” to evict the man.<\/p>\n\n\n\n

CDH said the judgment serves as an important reminder that retirement villages and estates cannot rely solely on a literal interpretation of contractual clauses when seeking to evict surviving spouses. <\/p>\n\n\n\n

The law firm added that operators should ensure the details of residents’ spouses are properly recorded and updated to avoid similar disputes in future.<\/p>\n","protected":false},"excerpt":{"rendered":"
