{"id":867805,"date":"2026-08-04T09:42:41","date_gmt":"2026-08-04T07:42:41","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=867805"},"modified":"2026-08-04T09:42:44","modified_gmt":"2026-08-04T07:42:44","slug":"the-department-of-employment-and-labour-is-looking-beyond-employment-equity-documentation","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/industry-news\/867805\/the-department-of-employment-and-labour-is-looking-beyond-employment-equity-documentation\/","title":{"rendered":"The Department of Employment and Labour is looking beyond Employment Equity documentation"},"content":{"rendered":"\n<p>Many Designated Employers believe a Director-General (DG) Review begins when an Inspector requests their Employment Equity (EE) documents.<\/p>\n\n\n\n<p>In reality, it begins long before that &#8211; with every recruitment, promotion and termination decision the Designated Employer has made over the course of its Employment Equity journey.<\/p>\n\n\n\n<p>EE is not an HR compliance function only. It is a governance responsibility that requires oversight from Top Management, including the CEO, executives and boards.<\/p>\n\n\n\n<p>As the Department of Employment and Labour (DoEL) prepares to open the 2026 Employment Equity reporting period on <strong>1 September 2026<\/strong>, a significant shift is emerging in the way compliance is being assessed.<\/p>\n\n\n\n<p>Our experience at EECMS suggests that DoEL inspections are increasingly moving beyond verifying whether employers have submitted the prescribed documentation.<\/p>\n\n\n\n<p>Greater emphasis appears to be placed on whether EE is being meaningfully implemented, supported by objective evidence and integrated into organisational decision-making.<\/p>\n\n\n\n<p>Imagine being asked to explain why an appointment or promotion was made a year ago \u2014 and discovering that nobody can produce the evidence supporting the decision.<\/p>\n\n\n\n<p>The question is not only: &#8220;Have you submitted your EE Reports?&#8221;<\/p>\n\n\n\n<p>The real question is: \u201cCan your organisation substantiate and justify the EE decisions it has made?\u201d<\/p>\n\n\n\n<p>Our experience during recent DG Reviews suggests that Inspectors are placing increasing emphasis on the reasons behind EE workforce movement decisions and the evidence that supports them.<\/p>\n\n\n\n<p>Where Designated Employers have not achieved their EE objectives, they should be able to justify the reasons, demonstrate that their decisions were reasonable and provide objective evidence supporting those decisions.<\/p>\n\n\n\n<p>Whether vacancies remained unfilled, employees not promoted, suitably qualified candidates were unavailable, organisational restructuring occurred, or CCMA awards or business conditions changed &#8211; Designated Employers should be able to substantiate those reasons with documented evidence.<\/p>\n\n\n\n<p>The principle is straightforward: If you cannot prove it, you cannot defend it.<\/p>\n\n\n\n<p>Supporting evidence may include recruitment records, interview outcomes, workforce planning, succession planning documentation, organisational restructuring records, labour market information and other objective evidence demonstrating why decisions were made.<\/p>\n\n\n\n<p>This reflects a broader change in the Department&#8217;s approach, with a DG Review being more an assessment of governance rather than a simple \u201cchecklist-based inspection\u201d of EE documentation.<\/p>\n\n\n\n<p><strong>For example:<\/strong><\/p>\n\n\n\n<p>An organisation appoints a candidate to a management position because that individual possesses scarce technical skills.<\/p>\n\n\n\n<p>A year later, during a DG Review, the DoEL asks why the appointment did not advance the organisation&#8217;s EE objectives. <\/p>\n\n\n\n<p>If the employer can produce interview records, competency assessments, recruitment reports and evidence supporting the decision, it demonstrates that the decision was objective and justifiable.<\/p>\n\n\n\n<p>Without that evidence, the decision may be considerably more difficult to defend.<\/p>\n\n\n\n<p>A DG Review typically begins with a <strong>Procedural Inspection<\/strong>, during which the DoEL requires the prescribed EE documentation to be submitted within 5 calendar days.<\/p>\n\n\n\n<p>Where concerns are identified, the Procedural Inspection may progress to a <strong>Substantive DG Review<\/strong>, requiring Designated Employers to comply with the recommendations within 30 calendar days.<\/p>\n\n\n\n<p>At EECMS, we have observed a noticeable increase in the number of DG Reviews conducted by the DoEL.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">One clear trend has emerged: Compliance documentation is not enough.<\/h2>\n\n\n\n<p>Designated Employers are being assessed not only on Legal Form &#8211; whether they have complied with the legislative requirements &#8211; but also on Substance &#8211; whether EE is meaningfully being implemented and delivering meaningful workplace transformation.<\/p>\n\n\n\n<p>Employers are expected to show not only that they have complied with legislative requirements, but that EE is actively influencing recruitment, promotion, succession planning, skills development and other workforce decisions.<\/p>\n\n\n\n<p>Four questions every executive should be asking:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Can we objectively justify every significant EE decision?<\/li>\n\n\n\n<li>Do we have documented evidence to support those decisions?<\/li>\n\n\n\n<li>Is EE embedded within our organisational decision-making?<\/li>\n\n\n\n<li>Would our decisions withstand scrutiny during a DG Review?<\/li>\n<\/ul>\n\n\n\n<p>If the answer to any of these questions is uncertain, now is the time to address those gaps &#8211; not when an inspector arrives.<\/p>\n\n\n\n<p>The 2026 reporting period marks more than another reporting cycle. It reflects a fundamental shift in the way the DoEL assesses EE compliance.<\/p>\n\n\n\n<p>Success is not measured solely by reports submitted each year.<\/p>\n\n\n\n<p>Designated Employers are expected to prove that EE is embedded in leadership decisions, supported by credible evidence and delivering meaningful workplace transformation towards the sectoral numerical targets.<\/p>\n\n\n\n<p><strong>In conclusion:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Every workforce movement decision could become tomorrow&#8217;s inspection question.<\/li>\n\n\n\n<li>EE compliance is no longer measured by what you submit, it is measured by what you can explain and prove.<\/li>\n\n\n\n<li>Documentation records history.
