{"id":871490,"date":"2026-08-21T11:50:48","date_gmt":"2026-08-21T09:50:48","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=871490"},"modified":"2026-08-21T11:50:51","modified_gmt":"2026-08-21T09:50:51","slug":"new-conspiracy-instigation-and-incitement-laws-for-south-africa-are-coming","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/government\/871490\/new-conspiracy-instigation-and-incitement-laws-for-south-africa-are-coming\/","title":{"rendered":"New conspiracy, instigation and incitement laws for South Africa are coming"},"content":{"rendered":"\n<p>New laws are set to be implemented in South Africa to replace the Riotous Assemblies Act, which was deemed unconstitutional.<\/p>\n\n\n\n<p>The Conspiracy, Instigation, and Incitement to Commit Offence Bill is set to be introduced in the National Assembly by the Minister of Justice and Constitutional Development.<\/p>\n\n\n\n<p>The bill outlines the rules and repercussions for inciting or conspiring with another person to commit a &#8220;serious offence&#8221;.<\/p>\n\n\n\n<p>The bill seeks to repeal the Riotous Assemblies Act of 1956, which was intended to address riots and the conduct or publications which could ultimately lead to riotous acts.<\/p>\n\n\n\n<p>The Constitutional Court ruled that many parts of this act were a product of the apartheid era, and largely objected to the act being too broad.<\/p>\n\n\n\n<p>Subsection 18(2) of the act stated a person who &#8220;incites, instigates, commands, or procures any other person to commit a common law offence or a statutory offence, shall be guilty of an offence and liable to the punishment to which a person convicted of actually committing that offence would be liable.&#8221;<\/p>\n\n\n\n<p>The Constitutional Court opposed the Act because it made incitement to commit even &#8220;minor&#8221; crimes an offence, showing that it lacked specificity.<\/p>\n\n\n\n<p>The Court ruled that South Africa&#8217;s Parliament had to amend the act within 24 months, and that the words &#8220;any offence&#8221; should be replaced with &#8220;any serious offence&#8221; in the interim.<\/p>\n\n\n\n<p>The Riotous Assemblies Act itself was not declared unconstitutional by the Court \u2013 rather, specific wording within it was opposed.<\/p>\n\n\n\n<p>Despite the ruling that the words &#8220;serious offences&#8221; should be used in the act, the Constitutional Court did not clarify the phrase.<\/p>\n\n\n\n<p>This has led to the introduction of the Conspiracy, Instigation, and Incitement to Commit Offence Bill, which seeks to define &#8220;serious offences&#8221;.<\/p>\n\n\n\n<p>The bill also seeks to make conspiring with another person to commit an offence, and inciting another person to commit an offence, serious offences.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Riotous Assemblies Act<\/h2>\n\n\n\n<figure class=\"wp-block-image size-large\"><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/03\/laws.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/03\/laws-1024x576.jpg\" alt=\"\" class=\"wp-image-854042\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/03\/laws-1024x576.jpg 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/03\/laws-300x169.jpg 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/03\/laws-768x432.jpg 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2026\/03\/laws.jpg 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/figure>\n\n\n\n<p>The Riotous Assemblies Act has a tumultuous history in South Africa and was largely used by the Apartheid government to suppress political demonstrations.<\/p>\n\n\n\n<p>The Act initially provided powers to break up public gatherings that could incite violence and control explosives.<\/p>\n\n\n\n<p>Section 16 of the Act relating to explosives was repealed in 2003 following the introduction of the Explosives Act.<\/p>\n\n\n\n<p>In the 1950s, the act was used in conjunction with the Suppression of Communism Act to justify the arrest and prosecution of several anti-apartheid figures, including Nelson Mandela and Albert Luthuli.<\/p>\n\n\n\n<p>The act was also used by the apartheid government to issue nationwide bans on outdoor political demonstrations.<\/p>\n\n\n\n<p>In the post-apartheid era, the Riotous Assemblies Act was notably referenced in <em>State v.
