warning for homeowners in South Africa"},"content":{"rendered":"\n<p>South African homeowners who discover that their property is being unlawfully occupied should act immediately.&nbsp;<\/p>\n\n\n\n<p>This is the feedback from Geoffrey Allsop, a senior associate at Pinsent Masons Africa LLP, who said the first 48 hours can be critical to preventing an occupation from becoming entrenched.<\/p>\n\n\n\n<p>In an interview with <a href=\"https:\/\/omny.fm\/shows\/afternoon-drive-702\/property-owners-must-report-a-house-hijacking-or-unlawful-occupation-to-the-police-as-a-trespassing-case-within-48-hours-of-it-occurring\" target=\"_blank\" rel=\"noreferrer noopener\">702 Drive<\/a>, Allsop explained that the 48-hour warning relates to a legal principle known as counter-spoliation, which allows property owners to respond immediately to an unlawful invasion in certain circumstances.<\/p>\n\n\n\n<p>While there is no rule in law which refers to anything relating to 48 hours, he said the timeframe is still incredibly important.<\/p>\n\n\n\n<p>It relates to the requirement that a property owner must act immediately when someone unlawfully enters or attempts to occupy their property if they want to rely on counter-spoliation.<\/p>\n\n\n\n<p>Under this principle, a person may, in certain circumstances, remove unlawful intruders without first obtaining a court order, provided the response is immediate and meets the legal requirements.<\/p>\n\n\n\n<p>\u201cI think that anything beyond 48 hours would be difficult for you to show that you&#8217;ve not acted instantly,\u201d Allsop said.<\/p>\n\n\n\n<p>The distinction is important because South African law generally prohibits evicting people from their homes without a court order, even when they occupy the property unlawfully.<\/p>\n\n\n\n<p>In South Africa, high-profile property occupation cases have demonstrated how the balance between constitutional property rights and housing rights can cause legal battles under the PIE Act to drag on for up to 14 years.<\/p>\n\n\n\n<p>In this case, an owner fought 14 years to evict an elderly tenant who claimed a lifelong right of occupation, succeeding only after offering to secure alternative housing for her.<\/p>\n\n\n\n<p>Another case involved an inner-city building hijacking, which established the precedent that municipalities must provide Temporary Emergency Accommodation before executing evictions that would lead to homelessness.&nbsp;<\/p>\n\n\n\n<p>In Umhlanga, a landlord endured a multi-year High Court battle to evict an unlawful occupant who had been living rent-free in a high-end R12 million property for over two years.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Lengthy and costly legal proceedings<\/h2>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large\"><a  data-lightbox=\"post-image\" LLP<\/em><\/figcaption><\/figure><\/div>\n\n\n<p>Allsop explained that if an owner acts immediately and reports an attempted occupation as trespassing, the police may be able to intervene before the occupation becomes established.<\/p>\n\n\n\n<p>Allsop said the ideal outcome would be for property owners to notify the police immediately, allowing officers to assess the situation and take appropriate action.<\/p>\n\n\n\n<p>\u201cThe best thing to do would not necessarily be to take it into your own hands, but to inform the police,\u201d he said.<\/p>\n\n\n\n<p>He added that police officers are legally required to act when they witness a crime, such as trespassing, although the reality on the ground can be more complicated.<\/p>\n\n\n\n<p>In some cases, property owners have approached the courts for urgent orders requiring police intervention to prevent unlawful occupations.<\/p>\n\n\n\n<p>The problem becomes more complicated when owners discover an occupation only after being away from their property for an extended period.<\/p>\n\n\n\n<p>Allsop used the example of someone returning from a December holiday to find several people living in their house.<\/p>\n\n\n\n<p>In such circumstances, the 48-hour principle would not necessarily help the owner remove the occupants without following the ordinary legal process. The reason is that courts broadly interpret the concept of a home.<\/p>\n\n\n\n<p>Even someone who unlawfully enters a property and erects a tent in the garden could potentially establish circumstances in which the ordinary eviction process applies.<\/p>\n\n\n\n<p>\u201cThat could constitute a home.
