MTN cleared of fraud allegations
The labour court has cleared MTN of allegations that a former employee was fired for blowing the lid off alleged corruption.
Former MTN legal advisor, Mankakane Violet Magagane, was let go after MTN embarked on a restructuring exercise in 2012, in which 700 other MTN eployees were also affected.
Magagane followed her dismissal by lodging a case against MTN, alleging that she was discharged for blowing the whistle against alleged fraudulent activities involving R12 million in payments made to a legal services company.
The labour court found no merit in Magagane’s claims, and that the dismissal was “substantially” fair, MTN said.
However, the labour court ruled that, procedurally, Magagane’s dismissal was also unfair, as the time frame between when she received her notice of retrenchment and input for alternatives was too tight and unreasonable.
MTN has been ordered to pay Magagane 6 months compensation, while both parties will share the legal costs. Her claim for shares was, however, dismissed.
